From sections 9 of the ToS:

You should not expect any level of privacy concerning your use of the live communication features (for example, voice chat, video and communications in live-hosted gameplay sessions) offered through the Service. These communications may be monitored; however, we cannot monitor the entire Service and make no attempt to do so. You understand that these communications can be recorded and used by others, and communications in live-hosted gameplay sessions may be broadcast to others.

I can't see this being an issue tbh, but all the same, its a good thing to bring to peoples attention when making a purchase of Kinect hardware. If you value your privacy, just either unplug the camera when not in use or find a suitable cloth/cover to put over all the lenses when not being used with a particular software, as, the Kinect Camera is an (Always On Device) and with an internet connection ie. Xbox LIVE, it goes without saying that your privacy could be at risk of being breached, which is not properly brought to peoples attention from Microsoft when advertising Kinect.

I would say that they are covering their backs just in case they ever need to monitor you, e.g they get a few reports in that you are being overly racist etc (we all know it goes on but some can be a little more aggressive than others!!).

Also saw reports that terrorist are using in game chat as its nigh on impossible to monitor?!?! I guess its only a matter of time before the paedo's cotton on to it too so they might start getting a few enquiries from the police etc..... really, unless you're doing stuff you shouldn't be I wouldn't worry too much (you are aware that text/ emails and phones can all be recorded and monitored too right???
Well, if you guys are fine with this then good on you but I think this is unbelievable.

Websites giving you details to third parties is one thing but when a company have made it clear that they can freely listen and WATCH what you are doing, I think it's way over the line!
Yes, ASDA Dagenham had the same for £77 today. looks like it is coming down in price, I wonder what is afoot with Kinect Xbox 360 and Microsoft * putting my cynical hat on* oO

Would you trust a "Game warrantee" with what they are going through at the moment?
Does this come with a plug?

Completely agree what is this 1984? Honestly microsoft can go f$$k themselves. Privacy issues aside the kinect is a piece of junk imo and is still WAY overpriced, the ultra low res cameras make it close to useless. The 360 is just too long in the tooth these days to be buying 80 quid accessories, thing should be 25 tops
Oh and Amazon had a much better deal just after Christmas where you got this with 2 top tier games fifa12, battlefield3, froza4 etc of your choice for £10 each. Save the money for a WiiU

I thought that until I USED it as for junk, it's regarded by people who are a lot more clever than me or you as very high tech, that's why it's being used in universities the world over

Nah mate its **** and not worth 80 quid, your example of a student using it for his sh$$y little degree project impresses me not one bit
