There are 3 versions of BB8.
V1. This one
V2. Battle damaged appearance.
V3. Comes with a training base, allows you to explore holographic scenes without BB8 whizzing around
V1 and 2 come with a circular charging base. V3 charging training base is rectangular.

Could I buy and return to store and repurchase in their company
I would go to the customer service desk with them, explain the situation and M&S should refund the difference under their 'Making every moment special' policy. At the very least they should give you a credit voucher for the difference to spend in store. As the staff discount card can be added to an online account, you could also ask your inlaws to buy it online for you using the card and cancel the purchase you have already made.
