just reading millarcats excellent thread on this and wondered - when you go into tescos etc and they tidy the shelves - filling up spaces they often put different items above price ticket

i have often complained about this as it is - imo - mis selling

manager always says it wasnt intentional - well i dont see it that way - any help - i have to guve grief to a certain managher in local tesco - i am his worse nightmare

see quote from mc post

A company cannot continue to display or offer a wrong price. If you can prove the price was deliberately marked wrongly or they continued to offer it at the wrong price after they were made aware of it, this would be an offence of making a misleading price indication under the consumerdirect.gov.uk/gen…tml Consumer Protection Act 1987 . You can report this matter to your local trading standards department who will investigate and decide what action - if any to take.

I think all stores must abide by the advertising laws. For instance, my wife bought something from Tesco, when she got home she found that she was over charged. She went back and complained but found that she was charged the correct price. She took the manager to the shelf and found that the staff had put the wrong price card under the item. He told my wife that they have to give her the advertised price. So they did and received her refund.

+1
you go buy the shelf price not the one on the till

Not strictly correct - they can refuse to sell it to you at the advertised price eg if they spot an incorrect price before it goes through the till. If you have already bought the item then they have to refund.

True. Let's hope they don't spot them in time

If the shelf sticker is for a different product, it's not exactly misleading - Just the item in question has been set there to either fill space, or by some lazy customer who didn't want to put it back themselves.

However, if the shelf price is different for the exact product you are buying, you should be charged what it says on the shelf, as tills aren't always right.

Simple enough really, we get it frequently in Spar.

In the old Tesco "get the item free if we overcharge you" days - some Tesco staff used ask the customer to wait while they checked the shelf, they would then walk round, remove the offending label and then say the customer must have been mistaken.....

Even now when you get overcharged by Tesco, they don't offer double the difference, you have to ask for it.......
