ACS:LAW Threatening letter. Anyone else had one??

Got a threatening letter yesterday from the above mentioned firm requesting the immediate payment of £495.00 for a film i alledgley downloaded.
If I dont pay by the 24th of may court proceddings will begin and this price will rise with an immediate interimm payment of £1000 towards legal costs sort.
Apparently this is the 2nd letter I have recieved.
i have spoken with my ISP and they have said its a scam, so im just wondering if anyone else has had one??

Get that in writing (the ISP stating it's a scam) - And you'll be fine.

i was told that by a mate, he said he had a letter from his isp about something he had downloaded. i spoke with my isp last night (Virgin) and they assured me they would never give out my details without contacting me 1st.

why would they do that when the solicitors aren't doing anything illegal?

Can you post some details of this company contact name and number, im willing to call them to pretend I have received a letter and see what they say the scammers!

Dont phone ACS as they will not give you any helpful advice and will only scare you. Dont ignore the letter, take advice from consumer direct. You will recieve letters stating they will take you to court. when I spent time looking into this only one case had gone to court, and yet no one could find evidence of the case.

I helped a friend out when he recived letterf from ACS last year. He recieved 3., The last one stated they would take him to court in 30 days if he did not pay. He did not hear anything back from them.

Davenport Lyons was the solicitor that was dishing these out before.
I got several phone calls from trading standards and once they got involved Davenport Lyons dropped all the cases and passed them onto ACS.

Thanks. I contacted a solicitor and they said that they could only advise to wait the court papers, wihch obviously never arrived. I spent ages looking through the articles on the web. There was a fourum and a poll was taken on what individauls did when they recieved the letters. There was a few that paid. There was a solicitor that was initially offering advice for £25. Then he upped his fee to £250. He was probably in on "scam"

Advice seems to be...

Reply with a LOD (Letter Of Denial) by their reply date, but leave it till the last minute and send recorded delivery. Do not give away any personal information on the case which could be turned against you.

Complain to the SRA (Solicitor Regulation Authority)

Known to date....there have been 0 court cases over their "allegations".

Simply put, they will not take you to court because they cannot prove anything. Simply saying this IP address has downloaded something means nothing. They would need to take your HDD, image it blah blah, which in a civil case they cannot do. Send a letter back that you have not done anything, but don't waste your money on a solicitor.

ACS say they represent a film company who make pornographic movies. Its these movies that they are targetting the people they say that have downloaded the movie.(if that makes sense)

The letter gets sent out in the hope it scares you and makes you pay up to settle out of court.

can someone explain exactly what the scam is?

They get an ip address from torrents when the ip address is uploading/downloading a (suspected) copyrighted work.
They then go to court and get an order that an isp delivers up information as to who was using the address at that exact date and time.
They then write to the customer offering to settle out of court, which really is a must before any legal action commenced.

If you ignore them they don't (currently) seem to persue it any further.

But I'm totally lost as to how its a scam?
If it wasn't you tell them and they would then have to prove it was, if it was you then you have breached the copyright therefore they have every right to persue you.

how do they then? They can't go to the high court and ask for information on loads of customers from numerous isp's just by guessing a load of numbers.
I did see an ad by them asking for software to pull the ip addresses from torrents

it can be with other info and you know this, however this maybe a kicker come next year, maybe time to invest in a static IP or not in the case of this thread..........tricky

I'm still not sure how, armed with an IP address from a torrent client, these people can identify the individual PC behind my NATed router that I downloaded from (not that I use torrents mind). I mean it could be my laptop, my partner's MacBook, my XP machine, my WHS machine, my VM box, my media centre etc etc...

forget ipv6, if we run out of IP addresses, then it would be prudent to have a static IP however if you have a static IP with fixed routing its not that diffcult to say that an IP Address is now an accurrate method of tracing a single household for filesharing etc

I phoned ACS this morning aorund 9.40 and got through. I explained that i never recieved a 1st letter and he said dont worry about the 2nd letter they will resend the 1st one and amend their records....which i thought was strange.
I have alledgedly downloaded a film named "UK Student house 3" (an adult film) on the 20/09/2009 at 6.57pm
He said all the details will be in the letter they are going to send. He also said i used a program calle "Emule" to download it, which i have searched my pc and there is no such program on it.
I have also emailed them denying the allegation and requesting proof.
So now its just a waiting game. My wife is absoloutely fretting over this..the ******s!!!

Interesting stuff. Your wife believes you I take it, I can imagine these kind of accusations wrecking relationships up and down the country.
