Advice about email Quote which did not include VAT.

Found 12th May 2009
I enquired about a service & recieved an email with a price which I agreed to.

Just got the bill but it was more than expected as VAT had been added.

The email did not say that the price did not include VAT.

Is there any legislation about quotations and how they should be presented?

did the original quote say exclusive of VAT?

Not just said "I can do the above for £***.** "

No mention of VAT at all.

I vaguey remember someone telling me once that if you are quoting to a member of the public rather than a company you have to mention VAT but not sure how true that was.

I was a great help. I'm sorry

No that may help.

Although the quote was to me the payment will actually be made by my workplace.
(I was arranging a buffet for some staff which will be paid by work).

This might complicate things ????

Firstly ensure the supplier is VAT registered. If not they are not, they are unable to charge VAT if they are and you were receiving a quote for your company it would be assumed it is business to business and VAT would normally be charged. All the quotes I receive for work, there is never a mention of VAT, it is always assumed ( and does ) exclude VAT.

Hope it helps

Some food is zero-rated for VAT purposes

If your service fits mainly into the following list it is likely to be zero-rated:

* Food is taken away or delivered.
* You do not supply cutlery, china or condiments.
* You supply sandwiches and ancillaries rather than meals.
* Food is for meetings rather than functions.
* No service is supplied at customers' premises.
* There is a small number of servings per order.

However, if it fits mainly into the following list it is likely to be standard-rated catering:

* Food is eaten on site.
* The word "menu" is used.
* Service is more than just delivery.
* The food is supplied with serving platters, paper plates and napkins.
* Food is supplied above the ambient temperature. (This alone is usually indicative of catering.)

Don't know if this helps, but I'd check the wording on the quote - it might be that the service quoted was different to that actually carried out.
