I ordered and paid for items online 16/09/08. I paid for overnight delivery and received an email confirming items had been dispatched the following day.
I have not received anything, I've sent emails and left messages on answer machine but no one gets back to me?
The items are no longer required as I've had to buy replacements for a party last Saturday.
I sent them an email, saying I would take further action! Still no reply.
Can I take further action, and what can I do??

I've tried all of that, I've called their number and emailed them several times.
I mean independant because I'm being completely ignored. I have not received the goods I paid for and no reply to calls and emails made to them!

Thanks. I paid by a switch/maestro card I'm getting in touch with bank tomorrow. I'm keeping a close eye on my internet banking.

Hi. If there was an explicit option for overnight delivery, ie courier next day or Special Delivery and you paid a premium for this then you would be at least entitled to that postage cost refunded. All internet purchases carry a 14 day cancellation period so you can refuse delivery of the item and it can be returned for a refund, however you should check to see whether you would get a cash refund or a credit note as it was the delivery method that failed you and not the items, but you are definitely entitled to a cash refund on the premium overnight delivery.

By law now, all UK registered companies must have at least their trading address advertised on their website and/or electronic communications. If this is not the case then you can make a complaint to Trading Standards and Consumer Direct (both goverment consumer departments) who will take the case up for you should you fail to get in contact with the online retailer.

I would try calling the phone number at different times during the day and afternoon over a period of a few days just to check and see if you can get a hold of someone, although this isnt necessary. At first instance you should write to them or email them or both! then make a complaint to Consumer Direct who will then pass it to Trading Standards.

However, you must wait at least 21 days before any items can be declared lost in the post unless you have a tracking reference number, which, for overnight delivery, should have one and this should have been confirmed to you in the dispatch email. If not then it all sounds a bit shoddy to me. Persevere, I know its frustrating and disappointing, and from the Consumer point of view we all just want our money back asap, in reality it doesnt happen that way, it may take some time. Be patient, the law is on your side.

Another point to note is that if you have paid for the item via Credit card then you can call your credit card company and have the transaction reversed and they will give you your money back but you would need to contact them for further information regarding this.

If you paid via Debit Card you may still be covered under the Debit Card Guarantee Scheme, usually if your debit card has a VISA sign on it then your bank will be a member of this scheme but again you should contact them for further information relating to this.

Good luck with it and remember and be patient! I'm going through this situation at the moment and its been 4 months! So its early days for you yet and I'm sure you will get it all sorted out in the end. Cheers.
