    sorry, but this ^^^^^^^^

disconnect her phone if its in his name.

if he is tied in, 1 its a lesson, 2 report stolen and get it barred and a new sim issued.

does anybody know if we went to the police it would be classed as theft as have asked for them back and she wouldnt return them!

Who ever signed the contract has to deal with it till the end

I was sort of in the same situation, I just paid the contract off in one go

Just to stop everything carrying on

Oh yes that's correct, I also barred the phone so she could not use it anymore

That made her furious but it was certainly one up at my end

    Hehe

You would have to prove they were your property which I assume would be very hard to do.

the contract which they are tied to are in his name is that not prove enough

sorry i was a bit confused, she's had an iphone plus another 2 phones, claims to have lost the iphone but still has the other 2?

    Original Poster

no she had 2 phones one was the iphone she has lost the other she hasnt got but had the gift which was an xbox sorry for confusion getting me self at it now lol

So she still has the iphone in your sons name, then it is his property which I assume you could legally get back, however I also assume she'd lose that then too.

You could go to the police and say that the iPhone is your property,

your son should have the signature on the contract to say it's his

report to police the girlfriend had stolen the phone and refused to give it back

Your son owes the money to the phone company, but if he can prove that he had an agreement with the ex, he maybe able to sue her through the SCC for his loss. Can he email her and trick her into saying the phones were for her use in writing.

If she has sold the Xbox and lost the phone then there is nothing you can do but to report the phone stolen, call the network provider to block the sim.

If your insured and want the phone back then claim for it, you have the proof and no doubt the ex will testify to the police that it's lost. You never know, she might still have it and be prompted to hand it over.

I suppose this is a lesson learnt, I did go through the same so I know what your going through

Presumably he 'gave' her the phone, not theft imo

No one can make her give it back.
Report it as lost, and at least it's not worth much to her.

    She'll be stuck doing this:

Her word against his in my opinion

He has the document which supports that he owns the phone, she will either be scared into handing it over or he will have to claim off the insurance ...if he has any
