    Advice On Broken Xbox 360

    Hi there I know this isn't really what the site is about but you guys seems pretty knowledgable on these sort of practices.
    I've had my 360 for around 8 months and have now got the dreaded 3 red lights,I know I can ring Microsoft who'll pick it up and repair it but it seems a hassle, and I don't want to be without it for upto 3 weeks.
    Ideally i'd like to swap it for a new one at the shop I bought it from(GAME).
    Would I be entitled to this?
    Finally before it went kaput it made some strange grinding sounds which has left my Gears Of War disk badly scratched,am I entitle to have this replaced too?

    Any advice/tips much appreciated,great forum by the way.

    Yes under the Sale of Goods Act it needs to last for 12 months minimum.
    First 6 months they have to disprove fault. 7-12 they may ask you to show fault. GAME should replace it & the game or offer a full refund or the original purchase price. Do not be fobbed off - your contract is with them NOT the manufacturer. It is a statutory provision that goods are fit for purpose, and remain free from defects for a reasonable length of time.

    Agree with Sean. Got nowhere with the shop or phoning customer services.I sent a recorded delivery letter to the shop giving them 14 days to repair or replace under the sale of goods act 1979 (they're responsible for 6 years) , I got a freepost address from them to send the console AND reciept to test it, 3 days later got a phone call saying there was a new one in the post.
    Mine was 17 months old, 5 months out of warrenty.

    Cheers for the advice guys just on quick question, do I have to return it to the branch I bought it from or can I go to any Game shop?

    Hi,just got off the phone with them,they'll do the swap at the other store which is great,unfortunately they're saying they won't replace the game that was ruined by the machine,just kept saying it's company policy.
    I need some urgent advice/tips since i'm not the sort to go in there and start kicking off.

    It doesn't matter if it's company policy - merchandise they sold damaged other goods directly due to a manufacturing fault. Causation is obviously fulfilled.

    It has happened before, and those complainaints got their disks replaced.

    If they won't fix it - either stomach the disk repair charge (see manual of game for info) or relcaim it off them by billing head office/ sue them if you feel that strongly. Not really worth it imho though.
    Make sure you get a new receipt for this items - it has it's own 12 month warranty under SOGA so don't be fobbed off with them saying you only have 4 months under old warranty.

    Cheers for the good advice but I just got back and it didn't go how I hoped.

    The manager completely refused to budge on the replacement game issue. Second of all when I asked for a new receipt he refused that too, saying my warranty still only ran for the remainder of the original 12 months,the best I could get him to do was sign and date my original receipt confirming an exchange had taked place.
    I think my age may have worked against me.

    Just email their head office stating your concerns, ask for a replacement game + receipt to be posted within 10 working days or they can face legal action.
    If you need a letter drafted/ sent on your behalf feel free to pm me - might take a few days though.

    Sadly this is often the case, I often try to barter deals and no matter what I say I don't get very far, If its on the phone then its ok, But face to face it just doesn't happen!

    My brother who is a lot older often gets money off easily, Really annoying!

    Fair enough. Could try something extreme such as a law degree :P
    (or joining one of the professional associations as lay associate so you get a nice shiny membership card to flash)

    just chuck the xbox360 in the bin. its a rubbish console. ur better of with a
    ps3. xbox 360 pay their workers low and treat them badly in china and taiwan compared to sony who pay them a lot. ps3 has better graphics etc. trust me i know the games industry for 19 yrs.
