they can, but they dont have to

Make sure you do tell the seller your situation. You may have to proceed with the transaction if they're not happy with it.

They'll be able to offer a second chance offer to the bidder before you!

As for the trouble signing in, try deleting all your cookies etc. or try another browser.

you bid & won, hence a legally binding contract has been formed. Pay up and chalk it down to experience. Why should seller deal with someone else for a lower bid.

Could always put it back on ebay and sell it yourself?

it would be decent to explain whats happened and offer to pay the difference via paypal gift

yes i understand this i genuinely bid and after i won i called my mum who said she had already bought me the item and was keeping it as a gift for me i have 100% positive feedback here and ebay so this is not something i do deliberately.
if i have to buy it i will and just sell it on but wanted to ask what others thought anyway thanks guys for the replies

free selling this weekend !

To be honest I would just buy it an bite the bullet. I think you could ask the seller but to be honest do not be offended if they say no. 99% of the time second chance offers do not get taken up so the seller will have to put the item back on, more listing fees, messing about trying to get the FVF back, and the minimum of 3 days to re-sell the item again. All because of a mistake on your part.

So ?

Free listing you mean anyway. Save yourself about 12p but still pay the massive final and PP fees.

Just ell them. I once bought a psp game for someone only to find out they already has it so just emailed the seller explaining situation, they said no probs, cancelled transaction for me, it's just hit an miss, some selleres are lovely and co-operative, others not so much. No harm in trying, worse they can do is make you buy it lol!

It's not always a case of being co-operative though is it,unless it was a 99p start or a FLD then the seller will have paid fees to list the item, cancelling the transaction only gets the sellers FVF'S back not the listing fee.

In the case of the OP a lot of buyers don't take up SCO's,at the least offer to pay any listing fees.

I don't mean how you have taken it. What I mean is some people are quite flexible, I have had sellers do it for me, and I have done it as a seller for my buyers. Like I said there is no harm in trying, OP has already said that they will pay if necessary, so worth a try asking.
