Are customer returns within the __ days guarantee classified 'As new' if resold?

Sometimes we see items that are 'as new' for sale that are considerably lower.

I remember a few times that I purchase from Argos, the item was clearly opened before but I purchased them at full price expecting them to be in brand new condition. I would guess they were returned by the customers within their 30 day money back guarantee. Are these customer returns classified 'as new' or are retailers allowed to resale these items as if they are brand new?

No, as long as the box was not opened and seals were still intact - Thats for laptops and computers .... normally resellers will decrease the price around 5-10% if the box has only been opened

So, for example, if I ever receive an item purchased on the internet and it was clearly opened before, I should be able to request my money back including the delivery charge? or better yet, just refuse the delivery if I can tell from the box that it was opened before?

I have never had problems with this for internet orders though, but worth asking beforehand. Its always argos that I have this problem.

I bought a microwave from Argos sold as a new item. I queried when it was bought as the box had clearly been opened, and was told it was only opened for a customer view. I got it home and it had obviously been used as there was food burnt onto the top of the oven compartment :x

Of course I returned it and they did replace it with a suitable apology, but it does make me wonder what they try to fob people off with.

I've since refused to take an item in an opened box before and insist on a sealed box.

Ya I have had a few problems with argos but not as bad as your situation. Just wondering if internet retailers ship an item that works but was an item that was opened by another customer before would we be entitled to get a full refund including delivery charge. For argos, we can just return it to store but if buying on the internet, there are delivery charges involved.

Agree, never accept anything from a company if it is new and does not say 'as new'.
