I put down a £200 deposit on a Rover 25 for a cousin (2003, 52 reg, 23000 miles), she has now changed her mind and doesnt want a rover anymore! Where do i stand regarding the deposit? The total price for the car was agreed at £1900. Do i pay the £1700 and try and sell the car to get my money back or do i lose me £200 deposit. She hasnt got the money to pay me back as im loaning her the full amount for the purchase of the vehicle!

Any advice woould be helpful

Did you get a receipt for the deposit? If so what does it say on teh receipt?

thats what deposits are for .....to make sure you are serious about buying otherwise you lose it

If its a dealer try it on - use a sob story - its xmas they may let you off.

However as previously mentioned that's the purpose of a deposit - to show you are serious about buying somethin. Make sure you cousin realises that !

Deposits are generally non refundable. I once put a deposit on a car, before checking what insurance group it was, which turned out to be 17! Anyway, i phoned up and he wouldn't refund, so rather than lose a guaranteed £200 i took the whole car for £2400, figuring at least then i had a chance of getting it back. I then sold the car for £3000 :thumbsup:

I would make her have it, then tell her if she wants a different car she'll have to sell the rover herself. If she doesn't like the idea tell her to go xxxx Herself!!

You could also try and go down the sympathy vote. Your cousin has just found out she is being made redundant, and with it being just before Christmas, now can't afford the car

I would go see the car and see if it is 'as advertised'. If there are any variances, you could possibly agree to not buy the car. Or, transfer the deposit to another car they are selling?

No-one knows what garage you got it from, what their policies are, or what mood the guy is in when you go back and ask for it. None of us, unless the garage owner is on here, can clarify it one way or another, only you can get the definitive answer

Nah mate i understand that, was just wandering where i stood legally. Probably not legally entitled to it back but im not 100% sure though

I'm guessing you went to see the car and paid the deposit there and then in person? If not, and you paid over the phone, then you have some comeback under the Distance Selling Regulations and your deposit should be refunded

you pay the deposit to hold the item - if you dont take the item you dont get the deposit back - if you buy from the same person they can let you use the deposit against another item - but they dont have to
