    Argos Problem - Do I have Legal Rights?

    Hi,
    I purchased I item from Argos but the product in now out of stock and the item has been discontinued. The payment has been taken.

    Do I have any legal right to complain and what can I expect from Argos?

    I would appreciate any advice because im not very clued up on legal terms.

    Hi, im not a legal boffin, but i;m fairly sure that there isn't much you can do here, them taking the money or not makes no difference really

    I understand what your saying and I can see that they wont do anything other than refund me.

    The only reason I questioned this matter is because I thought I pay have some legal right if the payment has been taken and the order has not ben completed.

    Well, legally, it is very doubful from my understanding of this stuff...

    However... thats not to say if you complain sufficiently to argos, they might give you an apology voucher or something, maybe worth a try?

    With most companies the contract is not fulfilled until the item has been despatched,

    Good idea. It seems that I dont have any legal right so I will write a complaint latter and see what happends. I have nothing to lose.

    Argos did this to me once, they just kept telling me they would try and get it back in stock and deliver, went on for almost a year. They never offered to refund, but as soon as I asked for it, they said no problem at all, and did it straight away. I think perhaps they do have an obligation to provide once they've taken the money... though I've not tested it, and just took the refund.

    No. They will refund you and that's it.

    Thanks for all the replys and thanks for taking the time to check the terms and conditions for me

    I have come to the conclusion that I will have to accept a refund but I will write a complaint letter and wont expect anything but if get something it will be a bonus.

    Yeah, sue them for every penny they've got - is there any other answer really?
