    Banking and them not following their guarentees

    A direct debit guarantee means if an error has happened that you can ask for this money to be returned and the banks direct debit guarantee offers you an immediate refund, if this does not happen then surely the bank can be reported to somewhere?

    Not certain, I would be surprised that even if it does take weeks to process if they are not obliged pre-date the payment (and cancel any charges/compensate for loss of interest that have been made in the interim period). I'd assume the financial ombudsman is the place for escalating complaints...

    I believe that they are supposed to refund immediately, and then chase up the refund at their own leisure.

    You have to exhaust the banks complaint procedure first before going to an ombudsman.

    thank you jah, i have read up all about the immediate refund, but immediate from when is what i want to know, the bank is saying it may not be immediate and i have said about this immediate thing and they just keep saying we will deal with it and send it to the right department, last time this happended it took them nearly a month to refund me

    My understanding was, bank issues immedate refund, then claws it back off said compay, the bank arent inferring this happens

    Immediate should mean instant as I read it - as soon as is possible after the complaint is raised. Maybe the BACS hotline (0870 049 2717) is worth a call, unfortunately its an 0870 number and I can't find an alternative on say no...

    All direct debits are covered by the direct debit guarantee to protect the payer against any errors when payments are collected by this method. The direct debit guarantee states that if an error is made by the originator or the paying bank in the collection or paying of a direct debit, then the payer is guaranteed a full and immediate refund from the paying branch. The process is known as an indemnity claim.

    If an indemnity claim is to be made for a payment the process is as follows: -

    The payer must contact their bank to request an indemnity claim
    The bank re-credits the account the same day
    The bank then forwards the originator a bill


    Under the scheme, the bank cannot refuse to action the claim. The originator must pay the claimed indemnity within fourteen days regardless of the fault.

    yes and as per usuall i seemed to know more about the dd guarentee than they do, said it could take a few days blah, blah, have spoken to bacs who say usually within 24 hrs, but 48 at most, have advised me to go in tomorrow with a copy of the dd guarentee and see whats happening, the last time this happended it took them weekes to refund, i think there idea is claim the money back then refund me, this is not what is supposed to happen
