Beware - Amazon chasing up misprices!!!

This is a story from the US, but if they are successful, it could start being used here, which would mean an end to successful misprices:

"On December 23, Amazon advertised a 'buy one get one free' sale on DVD box-sets, but apparently did not test the promotion before going live. When anyone placed two box-sets in their cart, the website gave a double discount — so the 'grand total' shown (before order submission) was $0.00 or some very small amount. Despite amazon.com/gp/…502 terms stating that Amazon checks order prices before shipping , Amazon shipped a large number of these orders.

Five days later, after orders had been received and presumably opened, Amazon emailed customers advising them to return the box-sets unopened or their credit cards would be charged an additional amount ( forum.dvdtalk.com/sho…165 more forum.dvdtalk.com/sho…638 threads ). Starting yesterday, Amazon has been (re)charging credit cards, often without authorization . On Amazon's side, they didn't advertise any double discount, and the free or nearly-free box-sets must have cost them a mint. But with Amazon continually giving fatwallet.com/t/7…422 unadvertised discounts that seem to be errors, is 'return the merchandise or be charged' the new way that price glitches will be handled?"

This was the email Amazon sent out:

In reviewing your order placed on 23-Dec-06, we discoveredthat due to an error we did not charge you the correct amount for theitems you purchased. According to the terms of the promotion,purchasing one DVD at the regular price entitled you to a free DVD ofequal or lesser value. Because these items have already shipped to you, you can either keepthe items and we will charge you the amount you should have beencharged or you can return the items - at no cost to you - toAmazon.com within 30 days. Please note that we can only accept thereturn of unopened items in their original condition.If you decide to keep the items or we have not received the items youwish to return by January 28, we will charge your credit card for anyunreturned items.

Hmmm interesting. In a sense it's not a classic misprice, as the the rules were x amount of a box set, it is more of a till mistake. I don't know where the law sits in that regard. It seems a bit odd to me but I think the Americans are litigation hungry enough that if Amazon are pushing any laws someone will run after them for it.

You would think that Amazon had their lawyers on the case before these emails were sent out, to say they will be charging extra. They must think they have the legal right to do so. I can see a few court cases from that one though!

OH dear, I see problems arising

Not really a problem for people who were ordering because they wanted the product, since they wont be charged more than they were originally expecting and can return the item free of charge if they want to

However there is a problem for sites like this, because people go to get the deal not because they didnt mind paying the right price for the item

If they have opened the items though surely they cant return them unopened and will therefore just have to take it on the chin and pay for it.

Can't see how Amazon can make a charge to your credit card that has not been authorised. Perhaps US law allows this, but let's hope UK does not.

Surely you just report the card lost and get a new one. No transactions would be authorised on the old card then. Cant see what they could do after that.

From reading the thread, a lot of people called their credit card company and got it stopped anyway - some contacted amazon and also got it refunded
