    Bit Advice...Whos To Blame?

My Son took his Football to School this morning. After School his friend kicked it over a fence to him and its hit a car and dinted it. Who has to pay or is it a case of 50/50

well i would say whoever kicked the ball

id say, leg it, leave the football, take no responsibility and smile nicely at the driver

you have to pay, if caught

drivers insurance need to pay-I dont think you are LEGALLY bound to pay anything-it was an accident.

I'd say....the person who kicked the ball that caused the damage was to blame...

The football is the culprit.

what did it do to the car get a bit mud on it

    nobody has to pay

    barky is right here.

I remember a friend who was out doing deliveries at night and this drunk lad stepped out in front of the car playing chicken with his mates. Unfortunately for my mate, this drunk lad smashed off the bonnet.....but guess who had to pay to fix the bonnet? Not the drunk guy, but my mate.

I'm having the same bother with kids around here.

    Pop the ball,

    simples

could also depend whose car it hit

im guessing it's either yours or the parents of the other boy

But with them being children don't know if they could legally enforce anything anyway

Well the owner of the car got told it was my Sons friend so she went to their house to tell them it will cost £150 then that childs Nana came to mine and said I need to pay half because her Grandson said it was my Son.

If she believes her Grandson why would she be paying half??...Also My Mam was standing at my window and seen that it was my Sons friend that kicked it.

surely the parents of the boys who damaged it should pay

b*gger if i'd put it through my insurance

lots of things are accidents, car accidents happen all day long, but someone is at fault and pays

the car wasnt driving into the football to get dented, someone kicked said footy, dented car

he who kicked ball gets to pay for damage, if it was just a mud smudge then no damage, but a dent was mentioned, so money needs to be paid, and no, not the car owners insurance either.

depends on how old the child is - it would be covered by the criminal damage offence

intending to destroy or damage any property or being reckless as to whether any property would be destroyed or damaged

if you dont pay, you realise said car owner car sue you for the damages?

might as well just pay up

Or send the kids around when it gets dark to torch the car, everyones a winner

not you ,the parents of the ball kicker if they are decent people but you sound like a decent person or you would not be asking for advice so speak to the other parents ,if you get hassled i would report them to the police for comming to your house as this is classed as harrassment .If you have a named driver on a policy and they killed someone you wouldn't expect the policy holder to get done would you.

Don't see why you should have to pay at all - you're not responsible for the actions of somebody elses child.

    Haha.

Just go round, look at the dent, then go to the other side of the car and rattle a football off that side and dent it, then say "there we are, fixed"

and they are putting you right into position you shouldnt be, just because your son owned the ball doesnt make him guiltly at all, its the kicker of ball

you should stick to your guns here. your son's friend kicked the ball. he pays. you owe the car owner precisely zilch.

A 9 year old kicked a ball into a car and caused £150 worth of damage? Doesn't sound very likely. Have you taken photos of the damage and have the car owners got a written quote?

    Mod & Ed

have you seen the car? hard to believe a football kicked by a 9yr old could cause £150 worth of damage? could the driver be trying it on?

She's getting her friend to do it on the cheap she said. She's only had the car a few days.

a dent can easily cost 150, that isnt the issue,

the issue is, the ball kicker must pay, not lindauk's son, as he didnt kick it, so has no blame

Thanks everyone for all your help and answers. I'm just worried about what trouble that family could cause if I don't give them half.
