British Gas /data protection act? Discussing account with someone who isn't the account holder?

British gas rang earlier to speak to me about an overdue payment (they cancelled our budgeting card because I missed 1 payment, wouldnt reinstate it so other payments got missed as they didnt provide a decent alternative payment method that didnt involve going into town each week to pay in at a bank)

However I wasnt in so they discussed it with my partner whose name isnt on the account at all, is this legally right for them to even do this?

i wouldnt have thought so as your partner coul dhave been anyone. people have sitters in their home or cleaners or carers.

it should have been you unless your partner said you were married or soemthing

( read op worng lol )

you know what hydro electric have been calling me about some guy, that
A does not live here or ever has
    B hydro say/think he does
    C they keep calling
D iv told them where to go after constant calls fs

turns out the guy owes them money

Sure you haven't given permission in the past and forgot?

They never talk (or shouldn´t anyway) about stuff like that with anyone but the account holder.
My name wasn´t on the account along with my hubby´s a while back
and they wouldn´t tell me anything. So we got me added.
And switched from british gas to Npower.
Same thing though ;-) Just that the customer service is a bit better with them

It isn't "illegal" even if they did it without permission.

i went on a course for work the other month and they covered this a bit if i remember correctly, they cannot knowingley discuss the information reguarding your account and details of your arrears etc.so if your partner told them that you wernt there the most they are legally allowed to do is leave a message but the message has to be along the lines can you tell such a person brittish gas rang and could you ring back they cant say what it was reguarding. i would ring the complaints line or wateva they have as the call should be recorded.

I'm just fuming as she felt pressured into agreeing to payments higher than what we can comfortably afford.

Perhaps if you just paid them in the first place there wouldn't be a problem?

While this seems to be the issue, two wrongs dont make a right.

To the original issue tho, its not illegal as such, the company has broken the data protection act by speaking with someone else about your issue. At the end of the day, you have no claim unless the person who has been told the information has gained some sort of advantage against you, or you have lost out because of it in any shape or form. If you get what I mean.

If you feel something has to be said, I would write a simple letter but get your account up to date first. You may get a good will gesture.

Companies are usually strict with the data protection act so if you are genuinely worried about your personal data being shared, I wouldnt lose any sleep over it.

The original problem was I missed one weekly payment out of 2 years worth on a budgeting card where we agreed to pay x amount per week, I then paid double the next week when I could get to the post office where it has to be paid, they then cancelled they budgeting card as we hadnt "stuck to the agreement", so the only other payment plan they offered was over the bank counter which meant having to get to town on a set day each week and pay that.

The best bit? When a bill came in we was normally in credit!

As for goodwill gesture? We have switched to another company.

So that meant she then missed the next few weeks as how was she to pay when the card not in use anymore. So like yourselves, they offered her direct debit but at a lot higher then what she was paying.Good luck with this Harlzter:thumbsup:.

From his previous description of events that was a fair call - he said something along the lines of 'they made me go to the bank to make payments and I cba'

He's explained it better now, so cool.
