Take back to Argos, they usually really good and simply replaxe stuff.

Pretty sure they will sent if off for repair

Just ask for a replacement there and then. Pretty sure they will. You well in your rights.

Not a disc stuck in there?

Argos are really good though, especially if you've got a reciept

No you are not , the shop can insist on a repair, replacement or refund the customer does not get the choice.

Toys r us were also great too, our sons DS broke two days before warranty ran out and they just swapped it no question of repair.

It depends who you get serving you.

I took back a TV that was 11 months old and they insisted on sending it away - took it to the next store and they refunded me for it

    Go to Nintendo Service Centre.co.uk

If you are sure nothing is stuck in there just take it back and ask for it to be replaced.
they don't have to replace it but you stand a very good chance as long as you have the reciept.

Why? It's a few months old, and Nintendo have no responsibility to do it free of charge.
