    Buyer being really intimidating do i just give in?

    Still don't feel her claim is just but she's being really nasty and demanding a full refund or she will escalate??

    Obviously a nightmare buyer who will neg you anyway and as she is a trader she knows paypal may not side with her if you argue it, so she is trying to get you to settle without returning 200% profit.

    Tell her to jog on and YOU escalate it.

    If it's as described, and she escalates then all you do is offer a refund minus postage on safe return of goods via a tracked service - Paypal won't give her the item and the cash! Seems she wanted to make a quick profit of you, can't, now wants to have her cake and eat it.

    That's my thoughts. But she's being really intimidating through the resolution centre (constant !!!! to everything threatening to escalate so she gets all her costs covered).
    Tried exlpaining the picture show it minutes before it sold looking bright so i have no reason to question the fact that it's bright enough.
    How can i escalate it? It just seems to keep wanting me to respond to her which i don't want to do?

    You should be able to respond do it clearly as paypal will look at it, upload your pic and escalate.

    It's through ebay at the moment not pay pal. Is there a way of making them take over communications?

    Tell her return for refund minus post or escalate it thats all your going to offer i wouldnt back down hun you will prob get a neg anyway so dont give in to her as well.

    she wants me to refunded the total amount she paid including postge.

    I offered her it minus postage. It's a heavy ish item so about £3 paid to post plus packaging plus ebay fees.

    Just dont feel she is genuine. Do you think the pictures show a 'dull' unusable screen??

    Think she just wanted to re sell for profit and realised i'd sold it at a fair price so she couldn't achieve this.

    The best thing you can do is ask them to return via a recorded method so you can then verrify the fault and also check the "security" markings you put on the console and game. After this if it has been found to be at fault and not tampered with you will return all costs. Unfortunately theres not a great deal you can do and if they follow the proceedure then they will get a full refund eventually anyway. Ebay is just too buyer friendly now. best you can do is try to make it as inconvenient for them as possible.

    I had a buyer once making rediculous demands but once i requested they returned the item for checks they closed the dispute.

    I was thinking there could only ever be one outcome because ebay always side's with the buyer (even though in this instance they are a business dealing in these console and making a profit doing so!)

    If i'm set to loose i'll do it with dignity but on my terms! lol

    Stick with it and let Ebay decide,as it's an Ebay dispute i think it's 10 days before a decision is made if you and the buyer can't sort it out.

    Put in the dispute you told the buyer to send the item back for a refund but they declined.

    ah bless, why not take it to your local hospital i know they would be glad of stuff like that for the childrens ward:thumbsup:
    i took up an old ps1 before with some games and an old video player the nurses were very grateful as someone had stole the ds off the ward the week before

    Maybe you could sell items like that on here instead OP.

    I'd love it for my niece

    I used to sell loads on ebay but now it can be a nightmare. You're selling great items but every now and again you get a real pain in the bum to deal with!

    Sounds to me like they have looked at the photo and thought 'hmm, its nowhere near as bright as it looks in that photo', which is an incredibly naive of them - taking photos of a device with a screen is very hard to do and it is clear from the noise in the background that it is quite a slow exposure, as would be expected when using a pretty basic camera. Stick to your guns, if ebay side with them and expect you to repay all costs then that is a damning indictment of the unfairness ebay - offer to refund cost of item (minus P&P) on return and no more.

    I would escalate to a claim via paypal and see what they say, worst they will do is refund the whole lot! you might find if you actually speak to them (paypal) they will see it from your side, as it is not as paypal ask for "significantly not as described" its a used item sold in used condition, and you are a private seller, not a business. I would see it through dont give in to her bully demands and if she keeps it up report her to ebay. Seems like you will end up with neg no matter what you do now so see it through

    If it was buy it now, I seem to remember that they (the buyer) have the right to return it under the distance selling regulations (might be only relelvant business sellers though), and also if paypal rule in her favour she will have to return the item via recorded delivery so you'll only lose out on one lot of delivery (to her, not back).
    So one way or the other you should end up with the item back or you keep the money.
    She sounds like she is trying it on, not nice, and if you follow the rules and can back up your story to the eBay people they may consider removing any negative feedback.
