    Buyer says goods are broken a MONTH after received them?!

    Does anyone know how long someone has to examine goods you send them?

    We have had a buyer call us today at work to say that one of things we couriered to them is broken - it was signed for on 24th May, so pretty much a month ago!

    They have sent photos and it is definitely broken, but shouldn't they have checked it before this and let us know - maybe within a week of receiving it? I am kind of thinking they have broken it and are just trying it on ...

    I have tried to google this, but can't seem to find a definite timescale and wondered if anyone knew? Thanks

    are you selling on ebay??

    if it has arrived in perfect working condition then that is your contract pretty much fulfilled....

    not via ebay, via the companies own website - we couriered her several plastic items (not going into too much detail!) and they were all signed for and now a month later she has suddenly come back and said one of the plastic items is broken near the top - seems very fishy that she has waited so long to me, I think she has broken it herself and just trying it on...

    :w00t:! It's a tricky one as she works for a fairly well known company & I can't prove that they arrived in perfect condition... I might replace it for her and then add something to the T&C on the website about checking goods within say a week & then I will pass on your message to the next person who tries it!

    if it's not overly expensive then replace the broken item as a "gesture of good will" then next time she orders add a little to the postage..

    oh and definately add something to the small print ! lessons learnt and all that jazz...

    Do you know how long you are allowed legally though - all I can find online is 'a reasonable time' - I was thinking maybe a week or 5 working days?

    "reasonable time" can mean a lot of things - but yeah i'd say at least a week to try and test the item you have bought and paid for - if they ordered a lot of items then it may take a while to actually get around to using the item that is broken

    i know that if i bought a box of 100 biros for example i wouldn't take every one out of the box and test it before using them. might take me a month to find a broken one - certainly not gonna go back to staples and demand a refund...

    From a store or similar then yes. But from a private seller you inherit more risk because you don't have the statutory protection from the Sale of Goods Act 1979.

    i did something similar. Bought a laptop protective slipcase via ebay and left FB as soon as i recieved i had a quick look and as it looked in good condition and just left it at that. Then a while later (weeks) when i wanted to use it the zip was bust and the fibres were all loose on the inside.

    I didnt do anything about it, as it was my fault. I should have checked it properly when i got it.

    So this buyer could be messing you about or it might have actually been broken.

    She isn't saying it has broken with regular use - she is saying that she has only just unpacked it and it must have been damaged in transit - who waits a month after signing for something to unpack it?!
    (it is massively physically broken with a big crack along the top, if she had unpacked it, she would have seen it immediately)

    But legally I don't know how long you are supposed to give someone to report transit damage & we don't mention a time limit to check stuff on the website - I will be adding something to the t&c's though now.

    if it was a buy it now on ebay then the same consume laws apply as they would for any other internet sale, DSR's etc.
