Can I Return An "Opened" T-Shirt From Play.com?

I bought a t-shirt from Play.com the other day and got it today. It came in sealed packaging (manufacturer's, not Play's). I opened it and tried it on and it's faaaaar too big. Problem is, can i send this back in exchange or will they not accept it because it's opened.

well you needed to take it out to try it on!!! as long as it has the tags im sure its fine

Not sure if they will accept it, as it is opened. Refer to their terms policy. It says 'unopened' items only.

Especially being clothing, i don't think they will. Ring them up and check.

i returned t shirts that didnt fit, no probs, i put them back in the original packaging and tags were still in tact

Can't you use the 7 day distance selling regulations?

"the consumer has a cooling-off period of seven working days."

And just send it back saying you don't want it.

i told them they didnt fit, so they know i tried them on

I am almost 100% sure that if the company trades within the UK they MUST comply with distance selling regulations.

The fact it is too big is one of the reasons distance selling is in place. People cannot try on something before they buy so this was put in place to give you the option to return if you don't like it.
