Exam in what?
As I am doing a law degree, and if you are as well I hope you do actually know what it is!

Definition of Unregistered Land: Land that is not registered on the Land Registry and relies upon the history of title deeds. Since the Land Registration Act 2002 it has left very little unregistered land though.

Unregistered land is land which is not registered with HM Land Registry. This means that the property will not have a Title Register or Title Plan filed at HMLR.

The Land Charges register maintains a record of restrictive covenants, rights and mortgages relating to unregistered land. These are registered against the name of the land owner at the time the entry was made.

I dont even do a law a degree and i can tell him that. C'mon awoodhall, if you do a law degree like you say you do, give him some guidance eh?

I cant stand people who think that just because they do a law degree they know it all. Or that doing a law degree makes them smarter than everybody else. I do a law degree and if someone asked me i would help, instead of bragging that i know it and they dont. However i dont do land so sorry, i cant help.

The mind boggles at the thought that these topics could be summed up in a single post.
It is the equivalent of summing up a whole years work in one paragraph.
You need to know cases for the exam that illustrate each of these aspects, that is the only way to get decent marks in a law exam. Spend this evening learning the main restrictive covenant cases - Halsall v Brizell, Tulk v Moxhay and work out where the benefit and burden of covenants lie.
Co-ownership questions are usually about tenants in common and joint tenants - good summary here on netlawman.co.uk/inf…php
You need to get a basic book from the library and read through your lecture notes

PS. Watch out for the wikipedia links because they often refer to the Amercian system and not ours.

Co-Ownership: There are two types: Tenancy in Common and Joint Tenancy.

The Basics:
Joint Tenancy
This is where the owners are not regarded as having separate shares in the property. In this case, the owners are considered to be one legal entity, both in law and in equity.

However, there are four key points that you must know if you want to determine whether a co-ownership is joint tenancy. These four things must exist:
Possession – owners must be equally entitled to the possession of all the land (Bull v Bull).
Interest – each owners interest must be the same, i.e. in duration nature and extent
Title - the owners must have acquired their interest through the same document
Time – the owners must have acquired their interest at the same time

Co-Ownership
Tenants in common allows the parties to have separate shares of the property in equity. This may be assumed where the parties have contributed differently to the purchase price


Unfortunately, I am currently studying for a Company law exam and thus, can't offer an indepth tutorial on how to pass Land law lol
However, if you use the above information, you should be able to blag the rest using your common sense - and don't forget to stick some case law in there too (Bull v Bull etc)

Where did I state it meant I know it all? Or that I am smarter then anyone else?
I helped the guy with his question and told him what it was, furthermore, I was stating that I also do Law and that I covered those topics in my first year. Nothing more, nothing less.

Trust me I know I am not smarter then a lot of people, nor was I bragging, most people who are regulars on here know what I am studying, likewise I know what some people do for jobs or what they are also studying.

I bet if I had stated oh I do a Business Degree you wouldn't have taken the same approach, thus it is you who has pigeon-holed me. :thumbsup:

Multiple IDs are not allowed and will be banned (ie never to return)
The original ID will receive infraction points which normally leads to a suspension. This can be anything from 1 day to 1 month depending upon the volume of IDs created (but will return after the suspension

Suprised you don't name and shame multi's.
