    Car accident, advice needed.

    I had an accident in April 2008 on the M3, my vehicle was a write off and I was to blame (went into the back of somebody with no lights on). Anyway my insurance company paid out within weeks as I was fully comp. Out of the blue yesterday I had a no win no fee company ring up to say my wife can claim for injuries that happened at the time even though she did not see a doctor. I have rang my insurance company and they seem ok with this. Tonight a solicitor is going to ring to take the necessary details to make the claim.
    What should we watch out for?
    Will this affect my insurance (no claims?)
    Is it possible to do this when the accident happened months ago?

    Did she have any injuries to claim for? I was recently involved in an accident and despite saying I didn't have any injuries they still wanted me to put in a claim for a "minor injury".....

    Its not the insurance companies that lose out due to our compensation for nothing culture - it is us. At the end of the day its our insurance premiums that go up.

    Of course I saw it coming; I just couldn’t stop in time.

    Eye witnesses are believed to have seen the car driving erratically with the driver shouting "88 miles an hour"

    Are you always a gimp? Looking at your previous posts i'm gathering you just caught your lass noshing somebody else off, coz boy you is angry!!

    Your wife has a good chance of winning if she sues you, as it's unlikely that your insurance company will contest the case.

    However, you will almost certainly face a higher premium next time you renew your insurance.

    If she was genuinely injured then, by law, she is allowed to claim compensation, regardless of who was responsible - it just so happens that you're at fault. If you can put up with being sued by your wife then go ahead.

    Personally, I don't honestly think that I could do it, even if I was to drive into the back of another car & as a result injure my wife...

    If his wife suffered an injury due to his negligence (no offence Midgetman) why shouldn't she claim? What if she had needed constant care for the rest of her life?

    If she didn't have any injuries then that would be a different matter...

    correct - IF she had injuries then yes by all means go ahead and sue.

    BUT in this case she doesnt, didnt see a doctor so the OP will be committing fraud

    No - it just means they might have difficulty providing proof (if it is disputed). I suspect if a small claim is put in the insurance will just pay out. A large claim then they will dispute it......Depends how difficult the insurance company is going to be.

    Indeed she can...as previously noted she will in effect be sueing yourself as you were the driver at fault for said accident. It will have an effect on your premiums (and everyone elses for that matter) unless you have a protected policy.

    As also noted if your wife had never thought to claim before the unsolicited ambulance chaser's phonecall then why claim now? Her injuries obviously weren't severe enough to warrant this prior to this point so the claim that you are money grabbing stands.

    BTW the spelling is a Scot, and it should be Scotsman anyway. By your logic you may well be an Engg. Unless you know the poster and his first name perhaps?
