Car accident - claim 8 months later?,!

    Hi there.
On the the 17th of Feb this year, at a junction, I went into the back of someone. I set off and was probably going about 10-15 mph maximum, my front bumper was damaged and his back bumper had a some damage, nothing major.
We got out of the car etc, and he said not to get the police involved or anything like that as nobody was hurt etc.
He said I could either go through insurance or privately. I opted for insurance and everything went smoothly, with me having to pay my excess. Today in the post I've received a letter saying that the third party is now claiming for personal injury. I'm about to ring them, and he definitely wasn't hurt, so do I just tell them that?
It wasn't even his car that was damaged, so I have a feeling he could be trying it on.
    Cheers
    Jack

i had someone do the same. i never claimed, but then he claimed for whiplash etc. i bumped him @ at max speed of 5mph!!

Get your insurers to deal with it............otherwise you could just make it worse.

Why worry, your insurance will deal with it. Whether he trying it on or not is not for you to decide or even concern yourself about really. Just because he didn't look injured doesn't mean he wasn't.

Most people seem to try it on these days. Just let the insurance deal with it, you've paid excess already so it won't cost you any more.

i was rear ended whilst stationary in June.. the guy hit me about 25/30 mph ( he was on the phone talking...) i made a personal injury claim against him as i was off work for a week. Just about to get £2k in my bank ! no sympathy for idiots on the road -
you however OP - i feel for .. there is no need to leave it that long.. especially since there was hardly any damage

The insurance people will require his input, when you done it through insurance did they ask you to write a statement of what happened? if you wrote down that no one was injured you will be fine otherwise contact your insurance company and tell them.

The longer people leave it the better for them....claims are worked out on the type of injury and the longevity that it affects you, so a quick settlement isn't always the best option if you are getting recurring pain.

They took a statement over the phone. Just got the letter, and it's asking me to ring the insurance company back so im going to do so now.
It was partly my fault, partly his, he went to go, I looked right, went to move forward, and he must have seen the car and slammed on and I went into the back of him.

That's not partly his fault....it's all your fault you where ether not looking in front of you or you were to close to stop in time.

This happened to my husband he phoned his insurance company who said just send the letter onto them and they will deal with it. Haven't heard anything about it since.

how can it be partly his thought, when you hit him, even if he stop from pulling out you should be aware of this.
seen this thing loads of time on the round about where i used to work.

Mine was settled on the fact i will have fully recovered by the end of December. If my injuries were to continue past then ( on docs recommendation ) i would have had to wait longer and have further treatment ( physio ) which wasn't needed. i am happy with what i was offered although they tried to settle before my final medical...

Ok sorry, was my fault, anyway thats not really the issue here unfortunately
Argh, just can't believe this is happening lol!

No wonder car insurance has gone up with all these claims.

Guys i think my no claims is protected, and obviously I payed the insurance..
So if he does manage to claim, what will happen?

Just pass all of the details back to your insurance company, they have already dealt with the claim and it is still their responsibility to handle it. You have nothing to fear, you would only have had a problem if you had dealt with it privately and not informed your insurers.

It would bother me as well, cause this is one of the main reasons everyone's car insurance goes up every year.

That plus the indifferent selfish scum that profiteer from this ambulance chasing crap.

I understand that this in the whole is my fault, but there's no need to be like that.
I'm in a bad situation, and the last thing I need is your negative comments.

For people who seemed to care, I've just rung the insurance company who basically said that he will have gone through a independent company and will be assessed by someone he doesn't know..
However because the damage to my car was over £500 ( damn expensive MG bumper ) they have to pursue the case.
IMO he's gone through an independent 'no win no fee' company which means they will have used their own GP, and are obviously going to want to make money if that makes sense..

This thread, its self, is turning into a car crash.

Think it is meant to be an independent GP. They are very sympathetic to the person making the claim though

    Yeah thats what I'm expecting

I have just had an insurance claim resolved after 3 yrs 9 mths, I was stationary and was hit from behind, other party tried claiming all kinds of rubbish, solicitors wanted me to go to court in Nottingham, I live in the North east, but claimant had since moved to Notts!!!!. told them I had made my statement, nothing had changed, other party had changed his story, get on with it.

Are you a doctor? Whilst this obviously isnt the case here, people can have broken necks and not realise until later. Pain could start at any later date

dunno why you are worrying as insurer is liable for any compensation.
