Car accident, who is liable?

On the way to work today, was at a roundabout, car in front revved engine, went to go, pulled half way across the junction and then stopped because they claim a car was coming. I obviously saw the car pull off, saw the road was clear, went to pull out then bang, went into the back of the car in front.

Not much damage was done, only a few light marks on my bumper, and a plastic pannel fell off the other car.

I'm just interested to know who is liable in case it gets taken further?

I know thats how it normally works, but though as she's actually pulled half a cars length over the junction, surely she is in the wrong...

How can it not be your fault ?

Your fault, they will say something along the lines of that you should have been paying attention and looking ahead of you.

I've heard of this scam too, see them trying to claim there was 5 people in the car all with wiplash.

Ive been told to take photos to prove how many people were at the scene etc. and prove the damage on the car. they could say its a write off and it'll cost u more

Your at fault all day long on this one. Will take insurance company 5 seconds to establish you were to blame

I had the same thing happen to me a while back, stupid old woman pulled out on a clear roundabout and then changed her mind causing me to go into her! She didn't make a claim as her car was fine, luckilly. People who hesitate are def in the wrong in my eyes!

I know the type of drivers you mean :lol: but if you went into the back of here then its your fault gutting i know but that's the law unless you can prove she made a dangerous manoeuvre and unless you have a witness they will side with the hobbit.

Interesting... I doubt thats the case thoug, she was quite an innoced looking middle aged lady. But then it's always the innocent looking ones...

my mum got scammed this way a few months back. she was parked behind a car at a junction. the road was clear the car in front moved off and then so did my mum. the car infront decided to stop for no reason. she went into the back of him. there was no damage what so ever and obviously a scam but the other driver still managed to claim off my mums insurance

i don;t drive close to the car in front or assume anything, like i said drive so you are always in the right and I have my daughter in the car most of the time

the only bumper to bumper you should have is behind you then they are at fault if they hit you

No matter what excuse you make its still your fault. Even if it was a scam you shouldn't have been close enough to hit her end of story

She may be a bad driver and it's unfortunate, but technically it's your fault.
You should always have enough space to be able to respond in the event the car in front does an emergency stop, even if it's an idiotic emergency stop in the middle of an empty roundabout.

You should always take pics of the scene, traffic conditions, etc. However, it does sound as though you will be liable. She stopped and provided her brake lights were working, you should have stopped as well. Its unfair but iv had a woman do the same to me, jam her brakes on and I went smack into her. Very little damage so I just paid for a new bumper (from a scrapyard) and all was fine.

There are loads of scams on it, was recently on tv again as its been very well publicised but unfortunately still happens.

Luckily I assumed I would get the blame also, even though like you said it was caused by her stupidly poor driving.

I said I would buy her a new plastic bumper insert, only cost a few quid. Lucky the car I was in wasn't damaged, Porsche Cayman parts aren't cheap!

Even after 7 years experience, driving tons of different cars all over the country, it still happens. 1st time in 7 years insn't bad though

The police now want a piece of most accidents as well. If they find out about it, you may well end up with a Notice of Intended Prosecution for Driving Without Due Care and Attention

Sorry but you are at fault. It is your responsibility to ensure that the way ahead is clear before moving off and that you're able to stop the car in a controlled fashion in an emergency. (Such as the person in front braking suddenly!)

They will claim its your faulty.

It wasn't clear, she was in front. You should have left a safe distance.
