    Caught speeding by hidden camera.

Last night I was caught speeding around 8.45pm in a 30mph zone.

The road used to be a 40mph zone but the road has recently been changed to a 30mph zone.

I was doing approximatly 40mph at the time and a policeman sat in an unmarked dark blue car at the side of the road got me with a speed gun whilst sat in his car. He then proceeded to follow me, pull me over and give me a fixed penalty notice.

I'm not saying I should be let off as I shouldnt have been speeding in the first place.

Question is, is the policeman doing the speed trap not supposed to be visible?

He was hidden in the dark on a side road in a dark blue unmarked car sat in his car not even in high viz.

    Thanks for any help.

I was alwas told they had to be visible and be shown to be police!

Looks like the type of road and police ' hideaway' that i drive down daily to school , i have now learnt to always watch my speed at all times when driving that way , no consolation to you op i know , but at least you will be more aware now ................snidey buggers they are , lol

    Snare

Same! only time i have ever seen speed camara police its been in a highly marked van/Car

I thought the police had to have 2 officers in the vehicle :|, one to prove the validity of the speed gun configuration etc

OP try googling it and see what you find out, im sure there will be a list of rules that the police officer needs to follow somewhere

    Take a look at:

    pepipoo.com/

Pretty much all the guidelines are advisory although most police authorities do use them. All they need is two pieces of evidence. In this case the speed gun reading and the officer.

The gun does need to be a home office approved one so you may want to check that out as some forces are still using guns that are not now approved.

Also from the pics provided you were going from a 50mph zone to a 30mph zone. So was the 50mph zone previously changed to a 40mph zone and then to a 30mph zone? You may want to check that the correct paperwork has been filed for the change of speed limit as you would be amazed that this gets missed and the signs are not legal.

I believe the gun has to be calibrated daily and you can ask to see the paperwork proving it has been.
    No certificate - no legality.

    So I heard...

Bear in mind that if you decide to go to court and challenge it on a technicality and lose, they'll hammer your sorry ass..

You could always try here Nasty Nick

I blame GTA, op was a careful driver until they played it

Oh yeah, just ask to see a copy of the calibration certificate for the speed gun. My manager managed to get off once by simply asking this question!!

Yes in the pics its a 50mph going into a 30mph. Now its a 40mph going into a 30mph. However the 30mph zone has been extended to behind the linked picture.

I'll certainly be asking a few questions at the police station before I hand over my driving licence!

Really crafty place to park though in the dark in an unmarked blue car! From what I've read on the internet they are supposed to be visible. Oh well.

if hes a gambling man he can go that route but as deak72 said I you challenge and lose you normally get a bigger penalties

was it just a fine mate or points as well

i would just pay the fine if it was just a fine

    3 points and £60 fine.

I'll probably just pay it and take the points but its annoying when insurance is going to go up as well probably.

Maybe worth asking around if you could contest it or contact the police plead your case an see if they will let you go on one of those courses to save your points- i wouldn't be happy with racking up points

as you say it will prob punish you in terms of insurance quotes etc

Good thinking. If it's your first offence there's a high probability that you'll be offered the safe driving course.
Edit: I think the maximum speed you can be caught and still offered the course is 10% + 6mph, ie 39mph which would probably rule you out. Maybe it's not a hard and fast guide, i don't know.

Yes the guidelines state that the camera and or the officer should be visible and the signage should be a maximum/minimum distance depending on the speed limit on the road. Sadly they are just guidelines and sometimes the police don't like to play ball.

I think the rules are that you are actually supposed to stay below the speed limit otherwise you are breaking the law,

I'm sure the officer has to be outside the vechile when using the gun.. I'll try find info first though.

Ask if your local authority offer speed awareness courses instead of points and if they do whether you would be eligible, as if you get that then your insurance won't be affected.

Don't mean to be a cretin, but just to clarify where you doing ten miles over the speed limit?

Because you have signed the ticket to accept the offence and 3 points/£60 fine, there is nothing you can do now really. However I am pretty sure there needs to be 2 policemen in a car when pulling you over, but only if there is no speed gun involved. It is a pain but they are there to catch you out.

See those street lights? 30mph limit where you see those, isnt it?

On your google link there's a street signs showing the limit of 30mph with a warning of speed cameras too, there's also a sign for a school crossing which means the limit is 20mph.. not sure if this applies at night but id slow down just incase

I reckon you should just take the points and slow down next time.

If you do fancy being a pain and contesting the ticket, you could mention about how the police officer threatened you into accepting the ticket and that racist/sexist/descriminatary comment he made when passing it over, of course they can argue but without that second officer present it would be difficult
Doubt it would do you much good, but might at least get 2 officers in the car next time!

personally ive got a rule , if its government , lay down and take it , they make there own rules up , you cant fight them , you can try but they can just change the rules , if its a company **** em , so just pay your fine and get on with it and be more careful in the future

I hope 2 find some stuff out,for you later!

Thought it was only the stationary speed cameras that had to be visible. Mobile vans doing ANPR checks aren't advertised and highly visible as they need to catch the law breakers.

Spot on, it isn't difficult, even I can keep within the law.
