    Consumer Act / Warranties Help

    Hi all
    Just need a little advise re: Consumer Act / Warranties
    As part of my Barclays Current Account Plus (which I pay £5 per month for), I get extended warranties for upto 3 items.

    Currently have a Siemens Laptop which expired last week (25th)
    Anyway – back in June I rang Barclays to report a fault with the PC, and they agreed to send it away to COMART (Rotherham) for repair.

    Fortnight later, laptop came back with a new screen so we thought “great, all fixed – good as new” This lasted for about 6 weeks, when the same thing happened again, so like the first time, contacted Barclays who sent it back to COMART who, again sent it back repaired.

    Now, at the beginning of October it started to do it again but we were due to go away last week so left it until last week (22nd) to call Barclays which is fine as it was within the warranty period and arrange for a 3rd repair in a matter of months.

    Now, Barclays have only paid COMART £204.00 for the initial repair as subsequent ones are of the same issue as the first. They (Barclays) are saying that any replaced parts are guaranteed for 3 months only from the date of return of laptop.

    So, say the laptop comes back tomorrow (Nov 1st) which it wont, I will have up to and including 1 February 2011 to claim again. If however, the laptop develops an error after this date, Barclays are basically saying “I’m screwed” as it out of warranty.
    Barclays confirmed COMART have replaced THREE different parts since June (Screen/LCD, motherboard, and this time, something called the “inverter”)

    What I want to know is, where do I stand, come 2 February 2011 when the laptop stops working as it should?

    As this is a recurring / (obviously) non fixable fault surely I’m within my rights to request a new laptop - and who do I contact if this should happen, and I dont get any joy from Barclays or COMART

    This would depend on your warranty conditions.

    I would say that was the least of your worries after a 5-1 drubbing from your neighbours!

    tbh transit (or more like Trannie!) i dont care anymore. we were **** and our not so bad run so far had to end sometime. If they go out and learn from that and beat Stoke, and the rest of the teams in November, it may be a start - at the end of the season, when we're in a top 6 place, and they are wallowing in a bottom 3, then we'll have the last laugh.

    Anyhoo, back to the question... can you help?

    just a bump and update on this .. please bear with me as its a longish one and give best advise you can ... we're really stuck here.

    Laptop had to go back in AGAIN (4th time) now to be fixed, so was sent by UPS last Monday, Jan 24th (and received the next day.) Its now a week on from delivery and I've not had a text as normal to say if its being repaired.

    Its now 3 months outside the 2 year warranty, BUT the last repair was under Guarantee for 3 months (until 3 Feb). If/when it comes back and it needs to go back AGAIN, am I able to ask for a new laptop as there is only a finite amout of times you can try and fix something before you eventually give up?

    The 1st year warranty was obviously with the store/fitjisu, the 2nd with Barclcays, and like I say this expired back in October/November. Barclays would only pay the repair company (Comart) once (£220) as the issue was an re-occuring issue (screen flickering like mad!)

    Before last week, Comart had replaced the actual screen and contacts, montherboard and invertor, and when it came back in Oct/Nov it was fine until last week when we sent it in again? Now when it comes back we know its gonna last 4, 6 weeks max before the same thing happens again

    Where do we go from here, in respect of trying to claim for a new Laptop as it is, effectively still under warranty one way or another!

    laptop has come back and Comart have said although its been on test for 5 days, they cant find a problem with it? Now, suddenly as I type, the flickering screen is back!?

    Have they really tested it? - how will this help my case when the 3 month warranty runs out (any day now!?)

    Laptop company (Comart) rang this morning to ask if we had received laptop back. Said we had, but problems which they said werent happening were obviously still are. Lady on phone advised that MD had double checked the laptop before it was returned, and is now no longer willing for it to be looked at again?

    Have asked for an emailed report on the procedure for testing etc, and the MD name/email address. Awaiting reply from said MD but am not holding my breathe.

    Now, do I go back to my insurance (Barclays in this case) and tell them the company they are using refuse to fix the problem?

    Yes mate get back onto barclays. Your contract so to speak is with barclays, if comart are not performing that is barclays problem.

    Do not touch Comart Rotherham. They are using slave labour passed onto them from the governments mrwa scheme. They are supplied by a4e collaborators in Rotherham.

    not my choice mate. had to go through the insurance (bank) in the first instance. so stuck with him. Requested testing report from comart and email from MD last monday - still nothing!

    Just an update... just spoke to barclays regarding copying them into a complaint email to Comart and they directed me to Domestic and General as they are the actual insurers (Rang D&G and it seems they didnt want to know about the problems with Comart at all)

    Surely, you would want to know if a 3rd party repairer arent doing their job!?

    Anyway, as it is, email sent to Comart, and D&G copied in.

    well, after spending 4 weeks in the workshop at Comart (Rotherham), they are now saying they cant replicate any of the issues I was having. (They reckon is a local enviornmental issue!)

    Received laptop back Monday and within 48 hours, we're back to square one, with flickering screen issues (im currently posting from another Laptop as we speak)

    Spoke to Comart today via email (I refuse to speak to them over the phone as they try and fob me off with excuse after excuse)

    Their latest one being "your laptop screen if flickering - this is due to a location issue. Have you heard so such rubbish in all your life? They asked to try it at both parents, and a local internet cafe. We have, and needlees to say, we have still having the same issues.

    Does your camera have a video facility on it?
    When I had an issue with my computer I took photos, screenshots and a video. I uploaded them online to photobucket as well so when I spoke to Apple I directed them to the photos online.
    Maybe you can do the same?

    Already done this mate, and they've had 5 or 6 little videos over a space of a week. TBH I'm really fed up with Comart as they just seem to be fobbing me off with the "local enviornmental issue" thing.

    I know it isnt that as we've had it to 3 different places (family, friends etc) so it obviously has to be a faulty part they've replaced with a faulty part. Its so frustrating and I've now had to purchase a VGA/VGA lead to use the laptop on my living room tcv

    UPDATE:

    1st email sent to myself @ 1pm today stating:
    We will arrange to have the laptop back in with the probable course of action to replace the entire TFT assembly (Top Section).

    There is a possibility that this course will write off the laptop so we recommend you backup all data you want to keep. Any software work to recover your data by us would be chargeable. (This email was CC'd to the MD of Comart)

    then, a second email @ 5pm tonight, which said:
    I have checked with my MD. We are happy to have the laptop back in as per my earlier email but only the parts we have fitted would be covered under the warranty. (Screen, Inverter and Harness). As you no longer have cover with Domestic & General we would have to charge for any additional parts not originally changed


    To me, it looks as thou the MD has spoken to the workshop manager, and asked him to send the 2nd email. It seems as thou they're going back on their word, from their 1st email. However, I have an engineers report, stating the TFT screen has been replaced. Is the TFT screen and the TFT assembly (top section), the same thing?

    COMART are an absolute disgrace as a company. The manager Steve Massey needs a good smack in the face and I am not a violent man. I would never EVER use them again.

    Totally unprofessional and have no respect for customers what so ever. They have an Ipod of mine, it simpley needed a new wheel putting in, 4 weeks later its still not done and they cannot tell me when it will be fixed as they have now 'broken' the screen whilst trying to fix it.

    A simple apology, maybe the offer of a refund or something on these lines would be nice, but nothing. The items probably worth £60, so im not that bothered about it, but the lack of respect the employees show is nothing short of a disgrace. Just glad I earn in excess of £100,000 a year so I can laugh at the thought of them answering phones day after day for £6 an hour.

    Losers.

    I made the mistake of using Comart for a macbook screen repair.

    6 weeks later and after them replying to 2 emails out of 12 and NEVER returning my calls i finally get through to the so called boss who tells me the screen repair doesnt work and i need a £800 + motherboard repair. ! Absolute disgrace of a company, and now only realising this after losing £160 to them.

    My macbook is returning to me now, probably more damaged than when it went away. If that is the case i will quite happily make a detour next time i head south and vent my anger in the building.

    Never ever use this company, if you are forced to then try your hardest to refuse.

    I am a Gas Fitter and we are told to be cowboys.....at least i tell the customer worst case scenario and pride myself on decent customer service. These cowboys are a disgrace.
