    Cutting down trees with BT phonelines in the way

    Okay, I know the obvious answer here is to ask BT, and although I was about to, I figured that it might be a better idea to ask elsewhere first, just in case their answer came back not the way I'd hope, and instead my email just got sorted into a little file marked "If any of our lines get destroyed by a falling branch in X area of Edinburgh, here's the guy we sue".

    Anyhow, issue is, at the back of my garden in between my neighbour's property and mine, there is a phone mast. This sends out four phonelines, of which one is mine, and three connect to my neighbours. Problem is, the mast was placed in a position which means these phonelines hang over my garden, and are all threaded through my trees. This causes two problems. First, is that during high winds, these lines become liable to break, as is why there's now only four lines rather than the five that were there this time last year. Second, is that these trees are now growing far too large, and they need to be cut back. I cannot do this without branches falling onto lines and breaking them.

    Now, obviously I don't want to sever my neighbour's phonelines. I also don't want to cast shadow over my neighbour's gardens, and I have been getting complaints. I'm quite happy to cut branches off my own trees. So, what can I do with BT? Have they any responsibility towards my trees? If I do cut down branches and these break BT's phonelines, am I liable to pay for BT's repair costs? Anyone been in a similar position and have any idea of the best way forward with this?

    i would say trim the trees but just be careful and only take smalls bits off at a time...

    Y'know, I actually feel quite embarassed that I didn't think of that myself. I'd need to buy a new ladder for it since the offending branches are very high up, but that could well work out a very easy solution. Although, thinking about it now, I know my neighbour does have some massively elongated sort of tree trimming clippything. I don't know if it'll be long enough to deal with my trees, but it can maybe be extended. I'll have to follow this up, I'd never considered doing it in such a gentle manner. .

    I don't think they are, although, what makes them protected? I know they're old and long predate the houses of this area, but they're little more exciting than silver birch and cherry trees. I'm not going to cut them down, just plan on taking a few branches off. Is that legally okay?

    My next door neighbours phone went wrong a couple of weeks ago, it cut off mid call. Then no anything. Then an occasional ring but no connection. I reported it as a fault, and the next day BT came out and diagnosed tree rub. Then a cherry picker arrived and they cut off a few branches and replaced the wire. We're in a conservation area but it didn't seem to bother them as they discreetly poked the small branches in the hedge.

    BT have a legal right to trim tree's that affect their lines
