Hello.

I sold a laptop on ebay which worked 100% (except a loose hinge).
It was perfectly packaged and sent - and the guy says he didn't drop it.

My ad stated no returns.
Also, insurance was not offered by me.

It has now been 22 days since the auction was won, and now he replies to me to say he wants a refund as it does not boot up.
I know that this laptop did not have a fault. I just think the guy does not like the loose hinge - he bought the laptop on buy it now after only 7 seconds of the auction!!!

He left me positive feedback also.

How do I stand?

As it was an auction and it was advertised with hinge problem but nothing else, I'd say you are within your rights to refuse return.

22 days after auction also can give time for the buyer to abuse/misuse the system, which could also cause problems.

I would possibly advise getting full details of any fault and maybe just give the user some support on where to go next, just to give yourself piece of mind and show you are willing to help.

So if this person has purchased your product and left +feedback he was clearly happy with it when it arrived. As it is was sold as second hand and listed as faulty with no returns even though he is claiming a different fault, clearly a software issue has caused the problem, (maybe hardware) and is out of your control, then I believe even under the sale of goods act for second user products you will be found by (if it were to go that far) a court of law to be well within your rights to refuse a refund.

The law states the item must be fit for consumer purposes, even second hand. But as it was purchased with a known fault then he does not have any other come backs, especially as he has had it for 3 weeks and clearly said in his feedback that he was happy with the purchase.

OK, First thing.
Insurance is for the benefit of the seller NOT the buyer. How was it sent? Please, don't tell me First Class. :-(

Have you emailed the buyer? Replied to him in any way?

Yes, first class recorded delivery - as stated on the auction advert.

It arrived the following day ( I tracked it online) - and it was packaged securely.

I have not yet replied - I thought I would seek advice first.

If I was you I'd contact the other sellers who your buyer bought a Laptop from and see if they have heard anything from this guy.:-

I think he's trying to scam you.


You could email him and tell him that you've UV marked the vital parts of the Laptop and if he returns it and the marks are intact and it is faulty you will refund him. See what he says.
Or, you could just say naff off, you've had it three weeks, it never came with a warranty.

Not received may not work.
Not as described, Paypal will tell him to get expert written confirmation, which he will have to pay for.
