eBay dress too small... advice on returning to China?

I ordered a dress on eBay (well the wife did) and it's too small, so i emailed the seller the following message;
Hello I have received the dress however the dress size is not as stated in the description/listing - size 12 on listing states Bust 36" Waist 31" Hips 38" however the actual dress received measures - Bust 28" Waist 29" & hips 35" and is therefore too small. Please contact me ASAP to resolve as this dress is needed for a wedding. Thanks.

and had this response;
hi, dear ****, thank you for your email, we can exchange for the size,and when we received your dress back,we will checking the size, Look up is which employees made mistakes, very sorry for this ,please you could return them to us, my address is:room ***, building **,block(Nong) ***, ****** Road, Pu**** New District, ShangHai, China , thanks!

We also offer other solutions: 1.We'll give you 20% discount as a modified clothes cost,

My problem, it can't be modified because it's too small and if i return it what shipping service offers tracking to China and how do i get the seller to pay this?

We realize that it is difficult to purchase a wedding dress over the Internet, and we really want you to be happy with your purchase. Please contact us with any questions.
We will accept returns on standard size wedding gowns in perfect,
brand new condition (no smoke scents, no makeup stains, no alterations).
Dresses must be received back to us within 3 days of your receipt.
For exchanges, the buyer must pay all shipping/handling charges.
For returns, A 30% restocking fee will be charged on all returns .

I would be tempted to try going through paypal?? By the time you've returned it you'll be so out of pocket its not worth it.

If i put a claim in then how do i return it? i need tracking and from memory i don't think RM offer this service to China, don't know about the others?

Its up to you to pay return fees unfortunately

How did they send it to you ?


Just looked on RM site its nearly £18 to return to China tracked (2kg) , unless a courier is cheaper

Start a claim for the wrong goods and explain at least then you will be instructed of next steps and you have reason to claim the money back should it get lost.

You won't find anyone to fit a 28in bust, 29in waist dress.



except maybe a Chinese girl? I see what you're saying though, i'll get the wife to measure it again before i list it.

OK so i opened a PayPal dispute and the seller responded with the same reply as when i emailed him:
Seller's message:
"thanks for your purchase,we can exchange for this dress, you could return them to us, my address is:room ***, biulding **,block(Nong) ***, LingZhao Road, PuDong New District, ShangHai, China , thanks! "

so i have duly responded:
Your message to the seller:
"Please arrange collection or provide me with a UK return address. I am not paying +£30 to return a dress that has been delivered incorrectly by yourselves."


Let's see what happens now?

So after numerous emails back and forth the seller has agreed to a 50% refund (£30) and i keep the dress. I think that's more than a fair compromise, fair play to the seller.
