Before xmas I bought a DS + 50 games from someone on ebay for £350. The item didn't arrive for xmas but that is not an issue as it has arrived now. The problem is that I have not received 50 original games, it didn't say if they were original in the auction or not, nor did the picture used by the seller show 50 games. I received a M3 card with 50 games loaded onto a memory stick.

Does anyone know if I have any rights here, can I claim money back or go any further?

The seller is taking the stance that the auction did not say the games were originals and I have recieved what was promised in the auction. DS + 50 games.

Yes, you have rights. eBay do not allow the sale of counterfeit goods (although they do very little to police it).

If you paid by PayPal, then raise a paypal dispute for counterfeit goods received - PayPal SHOULD respond by forcing the seller to issue a refund.

No, the seller doesn't have to have the money in their paypal account as they will take it directly from their high street bank account, although you will have to provide paypal with proof of non authenticity for the games which shouldn't be to difficult as you could probably just take a photo to fax to them and it does take around a month for the paypal process! No, they can freeze funds and take directly from the funding source I think.

If they have sent you counterfeit games, then they haven't got a leg to stand on. And for £350, it is pretty reasonable to expect that you wouldn't be getting copies.

It's a while since I traded on eBay so things may have changed slightly, but the "buyer protection policy" should cover you.

i would get in there quick for your refund before he shuts down his account, and for £350 i would defo expect genuine games as these disks were only goin for about £50 on their own, i got scammed at xmas as well, i bought "genuine" sealed ds games which worked for about an hour, so i left positive feedback but the nxt time i put the game in, ds showed no game installed, only £15 each so i have put that down to experience, as my seller is no longer a registered user

I cant get the item number because the member is no longer registered on ebay.
What if the guy has also shut down his paypal? I better raise the request asap

go to your paypal receipt ,item number on that transaction

Your better putting a claim in asap as it takes a while.There is not guarantee you will get your money back- none of us will be able to know that for definate- but to try and get your money back you need to put a claim in Now and not delay.

You can still raise a dispute but you should get it done asap as the others have said- the seller was in breach of ebay T&Cs and so the dispute will be awarded in your favour and hopefully you'll be covered by Paypal protection still- let me know if you need a hand

If your paypal account has your credit card details (as opposed to a debit card) you can raise the issue with your credit card company - get a claim form from them - I got my money back from the credit card provider - they need proof of purchase and the dispute details (you need to raise a dispute)
