right, bought a phone from ebay and turns out to be stolen

what should i do ? and how do i get my money back ???

well i couldnt make phone calls nor recieve, thought it was the same prob as carzy but it wasnt soooo...

rang vodaphone and they said the phone needs unlocking, waited 2 days for the unlock code and input that and said the sim wasnt restricted

just got off the phone to vodafone and explained everything, he checked the IEMI number and its on the blacklist as its stolen !!!

want me money bk like !!!!

Contact the seller. See if they knew it was stolen and request your money back.

You should also report this to ebay as it's illegal (obviously) to sell and buy stolen goods.

iv emailed him saying i want a refund within 5 days and if i dont im gonna make a claim to paypal & let the police now !!

the bloke just said leave bad feedback, obviously if he doesnt use ebay he wouldnt know what to do, as far as hes aware no one can use the phone, thats his job !! haha

Paypal normally protect goods up to £500. Not sure whether stolen goods are covered though as it's usually just unreceived items. You'd like to think so though!

I'm sure if you let the police know they could possibly intervene and get this user caught. Hardly something that would interest them but at least you've performed your duty.

You can start a paypal dispute, and if the seller is honest he will give you a refund straight away, if the seller is dishonest, then you'll probably receive your money through paypal, within a month

I once managed to get £9 back via paypal from a seller who sold me a blatant copy of a film. took forever though and they wanted all sorts of evidence and statements from experts! in the end took a picture of the dvd & emailed along with the sellers non-too-polite correspondence. got there in the end.

i know its prob gonna be difficult but try to get the seller to email you something along the lines of him knowing about it but not giving 2 sh*ts. best to try and ruffle his feathers by threatening legal action, petty claims etc and hope he reacts abusively! then send that to paypal as proof he's a deceiving git

i wouls start with paypal and go from there.well an ideal conclusion would be the seller being honest, and not knowingly selling stolen goods,a refund given straight away (you never know they may of obtained and sold it in good faith) give them a chance at least,but with starting the ball rolling with paypal your covering yourself

As Loupomm says the seller may not know he's one wrong, but as i said start the dispute with paypal, then either way you'll get refunded for your loss.

vast majority of the time paypal favour the buyer

and whats with the rudeness of whistling, i was only trying to offer advice

He may have sold it in good faith, why not try emailing him?

my advice is put a claim in as it doesn't hurt as if he gives refund back its not a problem but if he chooses not to you are already going through the process .the item is not as described paypal will definately vote in your favour but you may be asked to send prove its stolen fax details .don't waste time with seller as he could just end up stalling for time .you may have to send phone back if you do make sure you send it tracked .

Hmmmm......so for every negative there is a positive in life, the opposite to NO buyer protection must '=' YES seller protection? Am I correct?

I do not use eBay but my father does and a lot of people I know do, or at least one did. :roll: Can someone please explain to me why he does not have buyer protection if he has bought this phone via PayPal through a genuine eBay auction?

I take it this must be another one of eBays, (or is it PayPals?), made up policies? I get lost of these days, so many rich companies interbred and leeching off the rest of society it does get very confusing!!!

I'll wait until Big A comes back.

iv bought another N70 so i hope i get the money back haha

vodafone said it was on the black list, reasons being it was lost or stolen !

Thats what im thinking,

i think he contacted vodafone (or his insurance company) and told them he lost it to claim on the insurance to get a new phone.....not knowing that they block the sim ???

The phone in the picture says 'offline', was that because his contract had finished??
Sorry, but you have NO chance of getting a full refund from Paypal/ebay. You did not have buyer protection so it will come under Ebays waste of time Purchase Protection. They do not include P&P in a claim and they charge a £15.00 admin fee.

I would contact Vodaphone and try and get hold of their Fraud/Theft Department if they have one. See what they have to say.
To be honest I don't think this is a scam.

yip as its got the original box and its used not new so cant be lost in transit unless sent for repair

see if vodafone will tell you the subscriber details (doubt it)

i would fire an email off to him requesting a full refund including postage as vodafone want to know who is selling phones rported stolen to them
think vodafone need a crime report number too before they accept a stolen phone claim so he's also had to go see the police and make up a ficticious theft claim

if you put a vodaphone or Tmobile sim into the phone it looks as if it works !! but its doesnt, it wont let you rign out or ring in ?

yeah i agree, in theory the no protection bit of his add means nothing in my eyes !! paypal sort that kinda stuff out !!

ps, iv still to leave feedback, what should i do ? leave it now or when its all done ?

you ask what can they do? trace who reported it stolen maybe, then you may know if your seller has been pulling a fast one, i think its terrible that vodafone showed no interest when you called and they told you it was reported stolen!

You could tell them who you purchased it from. If it's an 'insurance' scam then you will be able to prove it's legitimately yours and they may turn it back on and chase your seller.

Don't leave feedback until it's all sorted.

Did you fund the Paypal payment with a Credit Card? They might be more help.
