    ebay help please..

    I bought a next gift card off ebay which has never turned up, ive tried contacting the seller but no response, since i bought my gift card the seller has sold over 6 more of the same gift card each with 1 day listings so i know the seller would have been getting my messages.
    I have tried to open a claim through ebay/paypal and it says im not covered due the way its listed. I have tried going through the terms and conditions ebay have and can only find that your not covered for even tickets nothing on gift vouchers.

    Can somebody help or give me advice to what to do next please?

    I don't you are covered for Gift cards,but not 100% sure.Did you pay by Credit card using paypal ?
    Contact paypal & tell them what is happening,but Phone them & that way you will get peace of mind as emails take ages.

    yes paid via paypal, when i try and open a dispute it says:
    We're sorry there's a problem with your purchase. Unfortunately, this item isn't in a category covered by eBay Buyer Protection.We don't offer buyer protection on items listed in the Real Estate category, certain Motors categories, or in Classified Ads. You can try to work out this problem by contacting the seller.

    Paypal says:
    '13.3 What type of payments are eligible for re-imbursement under PayPal Buyer Protection?

    a.PayPal Buyer Protection only applies to PayPal payments for certain tangible, physical goods that can be posted. Payments for the following are not eligible for re-imbursement under PayPal Buyer Protection:

    •items equivalent to cash (including, without limitation, gift cards)'

    Ebay also says this:
    'Exclusions from eBay Buyer Protection

    eBay Buyer Protection doesn’t cover services and certain categories of goods, false, abusive or illegitimate claims, or purchases where you have been or may be compensated by another third party. The following purchases are excluded:

    ~ anything that’s equivalent to cash (including retail gift cards)'

    Get the sellers details, his phone number etc (although I suspect its probably false - another reason to report them), see if you can get through though, its worth a shot.

    No way shouldnt ebay make you aware of this before bidding on them. So i dont have a leg to stand on.

    Yikes, I never knew this as have often bought vouchers from there. Won't be in future!

    OP sorry I can't help your situation as don't know enough about the legalities, but maybe worth reporting to your police station as its theft, also call ebay and paypal and speak to someone as the seller needs stopping so they can't scam anyone else.

    Oh also quickly leave negative feedback to alert other ebayers.

    You will need to still contact them as others will be getting scammed as well & you would be advised to go to your bank & tell them what has happened.If you paid with a Credit card then you maybe covered due to it being theft.Other than that I think you may need to do a small claims if paypal & the bank can't help.

    Give paypal a call today & see what they say first & they also have a duty to freeze the sellers account just now.

    16 days ago the auction ended and have been trying to contact since day one as i asked if they would message me the gift card number and pin, they replied saying yes they would. I paid and that was the last i heard from them. They have still got one selling at the moment. Would sombody try and and contact them see if they get a responce?

    Im sure theres somewhere, on the auction page or your invoice, that states whether you're covered or not??

    Just checked, there is.. On clothes etc, you'll see the shield and 'Ebay buyer protection' (under the item location, p&p, start price etc etc) on gift card auctions there isnt one. Have a look on your invoices, it might state somewhere on it that you aren't covered? Sorry OP, this is the first Ive heard about not being protected for this type of stuff.. Just leaves it wide open for people to be ripped off.
    You might find that Ebay refund you anyway as a one off. I paid for something via cheque before but the item didn't arrive, the seller refused to budge (saying I shouldve used Paypal instead) Ebay still refunded me as a one off gesture.

    I've sent a question about one of their other items for sale,so i will let you know if they reply.

    They have had neg feedback recently,have you seen it.

    I know it's of no help now OP,but also,don't bid on auctions that are private,i imagine the seller was pushing the bids up too with other ID's.

    I had a problem as got sent fake dvd box set and paypal refused to giveme money back as the seller told them they werent fake. I went to trading standards and it took 6 months fighting ebay and paypal but got there in the end with threatning to take to court and media. Trading standards even got police, so dont give up, take it further. and remember you can write a review in ebay and name and shame him, i did this and since had other buyers mail me. Even message the other sellers to see if they got there gift cards. Hope that helps a bitx

    As someone else said,you may as well try ringing Ebay and Paypal and mention the fact they have sold 18 lots of take that tickets and they might look into their account,also mention you suspect shill bidding,

    If you go to Goofbay.com you can see a sellers history as far back as 90 days,

    Wow, hope you get it sorted OP - I really never knew that you are not covered by Paypal for gift vouchers, the should make people aware as I wouldn't have thought to check myself.

    thats chat is a vertual assistant nobody actually to talk to, also still cant seem to get a number for them

    Just in case with that,i go into Ebay and change my phone number before i ask for the other persons details,i change it back again at a later date,rather that than they have my number.

    PayPal doesn't cover gift cards, but what about eBay's own buyer protection through their own resolution centre?

    have got there user info just done it and it still has my old number on the account so they won't have my number.

    Good luck OP and if the number is a dud report that to Ebay as you must have a current number on file.
    I really would leave that Neg OP you haven't got anything to lose at this stage as you're not likely to get anything and they appear to be ignoring you and they can't neg you back either.

    ebay have basically told me tough and are not even going to look into it. So the seller is going to keep getting away with it. Not happy
