ebay item not recieved and ebay/paypal wont get a refund

I bought a xbox live 12 month subscription a few weeks ago and emailed the seller and they didnt respond so opened an item not recieved thing on ebay and they said that they couldnt help because it wasnt covered by ebay because it was a code and then paypal said they couldnt help because a case had been opened with ebay. What can i do? Ebay cant let people sell things that arent coverd for can they, basically it means someone could open an account and sell a code and not send it but noone could get a refund of them?

sounds a bit fishy to me, have you phoned the proper ebay helpline thing?

Ebay does not allow the sale of digitally delivered goods, in other words the seller breached Ebays policy by emailing you the code, he should have sent it by recorded post.
So mention that to them and they should agree.

it said in the listing that they would photocopy and post it and when i said that to ebay they said....
I have reviewed your transaction details carefully. And I found ouot
that the item that you have purchased from seller stated above was a
subscription and as what youo have said it is a photocopy of the code.
Unfortunately, this is considered as an intangible item. And intangible
items are not covered by eBay's Buyer Protection Program

They put there feedback to private so the other 4 or 5 people's feedback that bought it aswell is hidden from the next lot they try and scam

Well if you paid by credit card call them they should be able to retrieve your money.

As far as i know you cannot sell an item once you have changed your feedback to private, i tried it and it doesn't work.

If i were you i would keep hassling ebay and paypal over this.

who should i hassle though? and if i've opened a case and they "resolved" it and i apealed it an they said what i quoted before and paypal just close the claim i make on them...

Ebay don't cover intangiable goods HOWEVER ebay do not allow the selling … Ebay don't cover intangiable goods HOWEVER ebay do not allow the selling of digitally delivered goods, so not only has the seller broken the rules, ebay have allowed a listing to go active and complete which by their own admission/rules should never have been on thier site for you to complete.You need to push this last point with ebay by ringing them.It's not always a case with pp/ebay that they favour/side with the buyer it's total crap sometimes you get stuck like this, fight them.



Just sent ebay a email saying this so thanks i'll have to see what happens, £25 i'll be losing!

Phone them too and op I would remove the sellers name, as naming and … Phone them too and op I would remove the sellers name, as naming and shaming generally is not allowed here, as you only get one side of the story, and those threads end up getting spammed:thumbsup:But keep fighting this as ebay should not have even allowed the listing according to their own t&c's the sad thing is they don't care as long as they get the fees, for a listing to be pulled it takes a browser to report it, it is in effect moderated by the public.
