Ebay phone help

I sold a half working phone on ebay (on saturday ), the phone was then stolen/lost.
I told the seller and gave him a refund,he now wants to claim on the insurance and get a new phone off me.He sent me this message

"I have contacted my insurance company and they have said that because of the time that the phone was stolen the phone belonged to me I`m entitled to claim. If you claim then you should give me the new phone or the value of. If you fail to do either then your breaking ebays rules"

The phone cost me £130.He bought it for £30.

Any ideas?

seriously though, the phone is not his until he receives it. it was your responsibility to get it to him. that failed, you refunded. end of.

yup. deffo. personally i would ignore him, or even report him to ebay yourself.

Why would he speak to HIS insurance company? Did HE have it insured? No insurance company would tell him anything of the sort.

OK he is p*ssed off that he's not getting the phone (and understandable), but he has absolutely no right to anything apart from a refund.

I'd be inclined to email him back and tell him to deal direct with HIS insuance company and what he decides to do after you have refunded has zero to do with you. Then tell him all future emails from him are being marked as spam and will not be received. I would also tell him that you do not believe any insurance company would tell him what he has told you and that you will be sending any further threats of blackmail to the police.

What a load of rubbish.Tell him you are quite happy for him to claim if he likes after he pays you the £30 + postage again. If you refunded him then the phone doesn't belong to him. If he pays again then it will and he can do as he wishes, but get it in writing that if his insurance company then refuses the claim you will not refund him. Tell him you will post him a reciept for the phone (stating £30 on it) recorded delivery to help with his claim (which will also protect you against an item not recieved chargeback if he decides to do one later). Bet that shuts him up.

Or just ignore him, depends if you want some fun with him

I feel sorry for people who don't have a place like HUKD to come to for advise about stuff like this, that would probably work on some poor souls who don't know any better!

What a chancer! No way would any insurance company tell him that. The phone would not be legally his until he had received it. As you have explained the situation and refunded him he doesn't have a leg to stand on.

Tell him to sod off! However, be prepared for a negative feedback, he sounds like a right git!
