Won a bag on ebay, which arrived today. Item is a totally different colour and design to the one listed and is an obvious cheap fake.
I put in a dispute with Paypal and the seller has responded with "send it back and I will refund you"... never had a problem like this before, do I send it back first or wait for a refund first ?
Also is there a way of finding his return address without asking?

You have to send it back tracked,either recorded OR Special Delivery,dependng on how much it's worth,then put the tracking details into Paypal and once it's tracked as returned you'll get your refund.

Wait for paypal to rule in your favour by claim, and then send it back with a tracking number, so that you can give the number to paypal and they will refund you from the sellers account when the item has been received by them ( The seller)

(Altho if they agree to refund before doing a claim or anything, just put a refund claim in on paypal, the seller will accept this and then you will need to prove with a tracking number you have sent it back to them)

Or so that is how it turned out for me when i had to do it

you can pull their contact details through ebay,go to help and search for sellers address...it should tell you how to do it,as a seller i have had one return and asked them to return via recorded delivery and provide the tracking number.......then i refunded the total cost plus the cost of returning the item.........thing is your seller is selling fakes so might not be so honest....did they post recorded to you?if not let paypal refund you then pop it in the post back to them

i agreed the same with a seller i bought from silly me i closed the disput as we came to an agrement, I sent the item back (to china) tracked cost me £8.30 to send back, and becuase the dispute was closed, im basically told haha you not having a refund,

Contacted paypal they said "theres nothing we can do becuase you closed the dispute"
paypal customer serive is CRAP!!

I missed the fake part,according to Trading Standards you shouldn't have to return it at all if it's fake.

If its fake you do not have to send it back from what i have read on here tell ebay its fake and wait till they tell you what to do never send it back without ebays say so make sure you open the dispute to a claim.

But as this is officially dealt by Paypal, I would recommend you to send it back.
But make sure you send it back on 1st or 2nd recorded delivery, therefore the seller have to sign it and also you get to track your item online.

well as item is clearly not as described...paypal will refund you on that alone.....just be wary of sending it back and the seller saying it has been "lost in the post"..........

yep just open a dispute and get them to refund you, don't offer to send it back as paypal won't make the seller refund you your cost of postage, so JUST say you want a refund, had lots of experience with this!

You could try telling them that TS have advised you not to return it as it's fake:thumbsup:

Once you have the refund,leave a neg explaining it is a fake and report any other auctions to Ebay for fake goods,there is a report button on every auction page:thumbsup:

Bit of an update.... The seller didn`t refund so I escalated the claim through Paypal, Paypal told me to return the item to the seller by recorded delivery, which I did on the 14th Dec.
Having checked with the Post Office it still says " is being progressed through our network for delivery."
What happens if he has refused delivery, will I still be refunded by Paypal?
