Ebay seller saying they haven't received returned item...help please

Hi everyone. I bought a faulty psp on ebay that was described as being in excellent condition but when i received it there were alot of scratches, scuffs and chips. I told the seller that it was not as described and i wanted to return it. They agreed so i sent it back 1st class recorded. I checked the tracking yesterday and it says that it was signed for by the seller but the seller said they haven't received it. They said someone must of forged there signature. They're now telling me that they contacted the post office and they said that i've got to deal with it my end and get a claim form. Could anyone please let me know if it is my responsibilty to put in a claim or should it be the sellers. Any advise will be really appreciated.

Oh yeh forgot to say that i paid with paypal outside of ebay because the seller said they would get the money quicker. Stupid i know especially when i've been using ebay for years. Have i still got a leg to stand on? Thanks for any help.

I think it is your responsibility to claim as you paid Royal Mail so they're providing the service to you.

I do not see how you can claim anything from the post office if the item has been signed for at the correct address.
I would still claim my money through Paypal though, The buyer is always right with them, and you have the tracking details.

How would the seller get the money quicker just for paying outside of Ebay ?

Its your responsibilty to claim from Royal Mail but you are only insured for £39 by recorded delivery. You will fill in a form of which they will investigate the matter further.

Unfortunately Ebay cant help as you took the silly route , though if the ebay seller aproached you first you can report him for selling outside of ebay.
You can open a dispute with paypal but I dont think that will help as you received the item but the dispute is now about the return.

yup if you file a dispute and have the tracking details they should fine in your favour, however, if the seller as no money in their account at time of dispute you prob wont get all your money back

Sounds like the seller has the PSP and the money and there is nothing you can do .

sending an item back thats worth more than £39 recorded is never a good idea in the first place, you should always use next day yes its more expensive but the item is worth alot so you should never skimp on things like that incase problems arises, in which case it as,

Although you used Paypal, did you use a credit card?

If you did then I would go through them to make a claim.

agree with above, put a claim through payal and add all your correspondence email and info on mailing. they should come out in your favor. i don't think you can claim via royal mail if it has been signed for - but you never know.

No it wasn't paypal gift. The seller paid fees. Thanks.

its the seller responablity to fill out a claims form as it was signed for at there address, they hav to prove it wasnt them and post office will investigate into it. having the same problem a buyer has said they havent recieved althought they signed for it and have phoned post office and was told i have done everything i can the buyer has to prove they never signed so down to them

if you paid with paypal gift then there's nothing you can do. However if you paid the normal way then file a dispute and paypal will most likely refund you if provide the tracking details

EDIT: I think you are still covered even if you paid outside ebay as thats why you pay the fees, so you are protected

You are not covered by RM as it has been delivered.

You are not covered by paypal, as you bought off ebay not on it, therefore you are not covered for a SNAD, which this is only an INR, but you did receive the item, they won't get involved in cases of not as described off ebay.

Try your cc, or chalk it down to experience.

i think as long as it wasn't paypal gift then you can claim via paypal, goodluck.

Just give paypal a shot. Make sure to escalate the claim so paypal investigate. Show evidence of all emails sent/received from seller asking you to pay outside and provide your tracking details.

No they are not covered this was an OFF ebay purcahse, so they are only eligible to claim for an INR (item not received claim) they received the item, paypal will NOT get involved in any other type of claim/dispute off ebay.

They won't ask for tracking details they will only be able to open an INR, seller will provide tracking voila op looses, seller wins.

Tinkerbell is 100% correct in what she is saying, Paypal ONLY cover you … Tinkerbell is 100% correct in what she is saying, Paypal ONLY cover you for ebay , a small amount of other companies may be covered , OP as the item is signed for you could always tell the seller you are going to contact the police as you have proof it has been signed for via Royal Mail and hope they get scared and refund.Paypal only works for buyers if you follow the guidlines set out by ebay AND paypal. buying outside of ebay is a huge risk and no cover for problems

Thanks everyone  Thanks again tinks for your words of wisdom. Definately a lesson learnt. I should of known better especially as i've been buying and selling on ebay for years. loads of scammers.
