Ebay transaction gone a little bit wrong..

Need some advice on this one. Basically here's what happens (I'm the seller).

- Buyer wins auction for a pair of speakers.
- Buyer emails me to say he will pick them up in 9 days and would I like a deposit?
- I email back yes and say a deposit will be fine.
- Buyer emails to say he will send a bankers cheque through the post.
- I email back and say Ok.
- Buyer emails to inform me he will be sending £20 via recorded delivery because he's unable to get to the bank.
- Doesn't turn up. But as a good will gesture and I know that some pikey bastard from royal mail has theieved it I let him come round and pick up the speakers anyway and pay the remaining amount, trusting that we can sort the matter of this deposit out later.

... Well its' been later and no sign of the deposit, can't claim it because it's cash (not covered by recorded delivery), and royal mail are still saying we should wait for it to turn up.

I have asked the buyer to accept responsibility for the cash not reaching me and would be willing to accept half of it from him, me comping the other half and putting it down to a lesson learnt.

He responds saying that he's already paid the full amount for the speakers and doesn't wan't to pay anymore. He also tried to say that I 'Ok'ed' him sending the cash, but I didn't he just emailed me to 'inform' me that he would be sending it, I didn't OK anything..

I respond with.. aw I'll just post my repsonse..

I do recall that you said you would be sending a bankers cheque, then you sent an email saying that you would be sending cash recorded delivery.. You didn't actually ask me if this would be ok or give me time to respond, so no, I did not 'Ok' this!

Sorry but I can't see the cash from the PO turning up and I think you should also take atleast some responsibility for the missing cash. It was your job to get the money to me, not the other way round! If someone buys an item from me and I don't receive the payment for whatever reason, I simply don't send the item. However in your case I let it slide because you seemed like a good guy and you had good comms.

Sorry, but if we can't come to some kind of agreement I will be leaving negative feedback.

Why would it be your responsibility, you don't even know if it was sent.

Let him leave you a neg, and leave him one in return.

how about agreeing with him that he pays half of it and when the royal mail arrives (if) then you'll send him the £10 straight back. he has the tracking number so he'd know wouldnt he?!

If he has proof of posting then I can understand him being upset (although proof of posting doesn't mean the £20 was actually in the envelope). What percentage of the overall selling price is the £20 you are short of? Has feedback been left yet and how much do you value your feedback?

If they have sent Special Delivery, the cash is insured for (up to £2,500), if Recorded Delivery, then they wont insure against cash.

Right, well basically I know he sent it because he showed me the recorded delivery slip when he came round.

Have looked through some old messages and it seems actually i DID ok the cash being sent recorded delivery.. Which I guess makes it my mistake too.

Doubt he'll agree to that Ace.. He think's because £95 has come out his wallet the deal is done.

Don't really want to damage my 360 positive (no neg) ebay feedback over a tenner..

Item sold for £95, £20 was the deposit. Feedback has not been left yet. I do value my feedback alot! Had my account for nearly 7 years and its 100% positive.

Do you have the actual tracking number? Or did he just show you the slip? Was the slip stamped on the back and properly filled in because he could have just faked that.

Right, so get him to put in a claim for £36 with RM, then when he gets paid out, he sends you £20 and keeps £16 profit :-D

I’m going to give it you straight. You were wrong in parting with the goods before receiving all the money. I’d forget about it and just learn from your mistake and that you can’t trust anyone when it comes to EBAY!

It is there reposnibility if they sent it and should have sent it Special delivery!! Should not have let him come round until you had the deposit! If he has it now, thats the end of the matter, they will just tell you to get lost!! Bad luck for you

Lucky you. Notify the buyer its being sent back to him and that you expect it to be sent back to you. Just check he got your address correct. Or tell him to come around and pay you the remainder.

There was money in the envelope - if you say anything else you are committing fraud - and if it turns up you will be found out!
If the tracking says it is being returned to sender, contact him again to work out a way of returning it to you.

If it turns up it belongs to the recipient anyway so they should give it to him and cancel the claim! Like I said nothing to lose.
