    Gutted! i hate 3

    about a 3 week ago i bought a samsung tocco and got 3 to send me my picture messaging and internet settings. Since saturday i havent had a signal so i rang 3 who said they have now blocked all 3 sim cards from working on any none 3 phone. They wont let me cancel my contract even tho i got the letter through the post. So now im without a phone. How much would a samsung tocco with 8gb memory card thats still got everything it orginally came with be worth now?

    im paying the charges on my phone but when i try to make calls it says emergency calls only!
    They said i can cancel my contract early and be charged £157

    the only reason i dont like three is their overbearing sales staff from india ....

    Yeh i upgraded my contract last november (12 month contract)
    But because my 18 month contract didnt run out until feb they said the 12 month contract only started when the 18 month one ended in feb.

    They gave me a w910i but i wanted a tocco so got that 3 weeks ago

    if you look you'll see nothing in the contract about HAVING to use a specific phone
    you can use the sim with any phone (thats unlocked or on the 3 network)

    IF they are saying you cant use the sim then they are breaking the terms of their contract and you can legally cancel with no charges as the goods they supplied (sim card) is unfit for the purpose it was sold.. i.e. work to make calls

    When you took the new contract out the old one was automatically cancelled unless they told you at the time you took the contract out that it woudlnt take effect until February... however they wont have.

    Why is it that anyone that hears the word 'contract' seems to freeze and become inert as well as Pavlovian - Its really very simple you have more than 1 choice (and before you mention about credit ratings, that can be affected in a negative way even being a goody two shoes - the credit companies are a law untoo themselves regardless of what legal or 'fair rights' **** you may be told) - 1. Cancel your direct debit until they either connect you and give you credit for the time or months lost so far. 2. Cancel your direct debit and go elsewhere, if necessary tell them they are the ones in breach of contract terms and they have been given enough time and warnings to rectify the problem. You can make calls, go back and forth, but in the end tell them its not open to discussion or debate and its an internal problem. If you pay the excess or listen to any further BS your basically an idiot If you dont you have taken a step closer to exercising free will and not being a yes person

    OK, think I gotcha now. I always thought if you upgraded early, the new contract kicked in there and then for the length of time agreed on. Maybe I got that wrong? Did you agree to that happening? (ie the 12 months were added to the start date of the 18 month one.)

    AFAICS, they cannot dictate to you what phone you use and as such they are in breach of contract by denying you a service.

    As you have already found out, dealing with the Indian call centre is pretty pointless. Even if they agreed with you on something, its likely they wouldnt actually do anything about it. So basically, I'd suggest you need to put in writing to them that they are denying you the service they expect you to pay for and therefore the contract is cancelled for breach of contract. (Tell them the phone they supplied doesnt work so you were forced to buy another - which is compatible with their 3G network.) Make sure you include a cc to ofcom as well, so they know you are serious. I'm sure Ofcom wouldnt be impressed - and they would know that. It could be extra leverage.
