Has any one had any joy with SOGA?

Bought an Xbox almost 2 years ago and the controller disconnects way too often. It wasn't so bad at the start but now seems to have got worse. I spent £300 on the console and I'm obviously not happy with it. I bought it from Game UK online and paid with a credit card I believe.

Before I write an email to GAME has anyone had a similar experience or any advice for me. Obviously they will try and fob me off and tell me to go to Microsoft to get it serviced at charge.

if you want to use the S.O.G.A more than 6 months after purchase you have … if you want to use the S.O.G.A more than 6 months after purchase you have to prove the laptop ["Xbox"] failed due to a manufacturing defect and not by misuse, the onus is on you to prove it by an independent report by a qualified person, the retailer / manufacturer doesn't have to prove that it wasn't a manufacturing defect.

Key is after 6 months the burden is on you to prove that the product was faulty at the time of delivery.

So you need to carry out a reasonable number of steps to establish this fault,
1/ Eliminate that the connection is not due to your router or router distance (thick wall...)
2/ Eliminate that you did not abuse the console physically (such as dropped it)
3/ Compare the wifi- strength on your unit with others (say your friends')

Thanks all.

Microsoft are wanting £84 to change the unit over. So will now contact GAME.

I really should have done this when under warranty. What a numpty.

If that means you will receive a reconditioned console with a further 12 (or 24)-month warranty, that may well be money well spent!

Have you updated the controller to the latest firmware?

You have no need to even contact Microsoft. SOGA which still applies to you (not the consumer rights act 2015) as you bought it prior to 1st Oct 2015, means you only have to contact the retailer. It is with the retailer that you have a contract, not the manufacturer. So i am probably not the only one to think that two years is not an unreasonable length of time to expect from an XBOX. In which case you are entitled to a repair, replacement, refund or part refund. The SOGA stipulates that consumers have up to 6 years from when it was delivered or purchased, unless in Scotland, where they have 5 years from when fault became apparent. Any remedy must be carried out with minimal disruption (inconveience) to the consumer. However, i know from experience it is not always so easy, as shop workers think that their own policies and procedures are the be all and end all. Since the OFT ceased to be, you will have to go through trading standards if you get fobbed off, or small claims court. Or you can use the credit card company. It does not matter when the problem started so long as you can prove it is faulty. But it can affect how much refund you are entitled to if you are offered one. It would be helpful to look through the SOGA if you can find it, i have it as a PDF but i was lucky to get hold of it before OFT closed.
