    Health Issue At Work

    Hi all,

    I got a mate who works in a dusty environment at work and he has asthma and has noticed it has got worse and doctor has told him the capacity in his lungs have decreased and works there any longer it will get worse and become an issue later in life.

    Can he say move me NOW???? As been a while now, can they not say no you cant move, if you cant work leave? Just want to know some info!!

    Is the very nature of his job to deal with "dust"...?

    He needs to contact his works HR dept,they will have clear guidelines for dealing with this sort of thing...he also needs everything in writing in case of claim for industrial injury,its a serious matter that needs to be dealt with more formally...if he cannot perform the work though he could lose his job as he is "incabable"

    Have a read of the case of Roles v Nathan 1963. From what I remember, the facts are very similar but it could be interpreted in a different way.

    There is also a well known case but it relates to damage caused by asbestos but the employees had not prior health issues.

    Many companies ask at interview, 'would your working conditions need to be adapted for you to work safely in the job applied for?'
    If he replied 'no' he's guilty of obtaining the job through a fraudulent statement.
    The company appears to be acting properly, if slowly.
    A difficult case for both sides.......
