HELP!!! Parking ticket unpaid??? **UPDATE** Help again pleeeease x

    Hi peeps,
A couple of months ago a friend and I took the kids to Mc'Donalds, we were also looking after someone elses children so we had 7 in total. At one of our local ones they have a play area for the kids so we went there. We were there for about 1 hour and 45 minutes. A few weeks later I got a paking ticket through the door because you are only allowed to park there for 1 hour and a half. My mate didn't received one as she worked there on nights at the time. I mentioned this to a few people (but not the friend that works there typically as we didn't see each other much) who said that I shouldn't pay it as they are a private company and not the police. (This has been told to me on here a while back too and I read it on MSE). So I left it!! Now I keep getting reminders and today got a red one talking about debt collectors coming round!.
Now, I know I am in the wrong parking for too long but I didn't read the sign when I entered the carpark (taking care in driving of course lol) and we had 7 kids with us in a play area that they provide for their use. The fine is now up to £150 - should I just pay it or is it right to ignore it??
    All help much appreciated x

    lol pss taker

    Private Carpark ?
    Non Goverment body?

No leg to stand on your no longer parked there and I'd also warrant a bet that they have no proof of you parking there either timestamps both ways etc.

I always wonder why they issue these tickets if they are not enforcable. Seems a waste of time. I have noticed that these signs are up in all the Supermarket, DIY, Retail parks near me. If this ticket cant be enforced then I would contact trading standards, and contact the company that is sending you thes letters stating that.

Because if they pressure and push alot of people will give in such as the OP who despite her "bill/fine" being increased from what it was is still asking whether to pay it.

Older people and over "concerned" people will always pay up to bully tactics.

Okies so they have camera equipment detailing a timeframe possibly! (This from OP's details was in a McD's carpark) however points still stands they are a private company as with Alfonse's thread he linked its still bully tactics.

OP how did they get your address out of curiosity ?

OP seriously. Move house sell possessions. Your either going down for a long stretch or the bailiffs will empty your living room

I had one in a similar situation, got original "ticket" then two reminders/warnings etc then nothing ever since. This was about 3 years ago.
Legally they could take you to a small claims court i think, but they never seem to, not that i've heard anyway, as it would prove too costly.
They probably just hope that people do without any fuss.

@Hanna - how did they get your address?

Must have been through the DVLA but I've heard that the DVLA do this for £2.50 or something silly like that and that it's legal!!

a ticket for staying 15 minutes over the time! WTF!

I don't know, I was just linking what appeared to be a useful thread on the consumer action group website. It does seem like bully tactics however that doesn't stop you from worrying.

Nicster, please change your avatar, it scares me

can you ring citizens advice and ask them ? usually helpful (that said i have only needed them once !)

we got a parking ticket from MacDonald at gatwick airport two years ago we was advised to ignore them we got letters from them every two to three months also had a red one and then a official looking letter from debt collectors which we chose to ignore (we looked on mse and they said the debt collectors was part of the same company) we haven't heard from them for a bout a year now

Which again reinforces this to be utter bully tactics.

Think of it this way if you had given the information you would know its prob not legit, however using a source of information without any input from yourself in regards to the address makes it actually look more LEGIT (after all how can they surely get your address if it wasnt legit) before you stating I myself did not know you could get that information so freely from the DVLA (which I find quite worrying to be fair, must remember to register my car elsewhere for purposes of Ex's).

    etc etc

I know people say to ignore those letters, but I don't think I'd have the bottle to! I'd probably have been the idiot paying up straight away.

Hence why these tactics keep going on and on, official notifications sure pay up but these tell them where to stick it in 99.9% of the cases.

Just ignore the damn letters and the ones that follow. Do you think they will spend hundreds if not thousands to take you to court for £80?

They rely on people Crapping themselves and paying up.

It's allowed once a month right? And the chicken legend only

I don't know why companies bother with these tickets. They all have a disclaimer 'vehicle left at owners risk'. Add that to a 1 hour parking notice, 1 hr 1 min later if the cars still there, brick the windows. Job's a good 'un.

Had one of these - please bin those letters. They can only take the driver to court and, unless you actually tell them you were driving, there is nothing more they can do.
The letters will follow a pattern, increasingly threatening and then dry up completely. These delightful people are quite happy to take the money from those who pay up and would soon be out of business if they incurred costs having to represent themselves at courts all over the country. Legal opinion suggests they would fail in any case because the level of charge is not commensurate with the nature of the so called offence.

Barricade your house and make a garrison.
When they come attack them with pots, pans and any other kitchen accessory you can grab.

    Hi Hannah,

I had one of these when I parked on a local Aldi car park a while back (cue the HUKD McDonalds-Aldi-chicken police).

I looked on the relevant forums already mentioned (MSE threads, peppipoo) and did exactly what they all said - I ignored it.

I goty a chain of correspondence - letters, letters witha photo of my car, debt collectors letter etc - after about 5 letters, they gave up.

Apparently, the initial "fine" is not a fine, it is merely an invoice for the amount. You agreed to the t&c's of the landowner when you entered the car park and by overstaying, you were in breach of them you naughty thing.

That's as far as it goes. They don't go to court or send the baseball bats round because it's not enforceable.

One thing the forums did stress though was to ignore the correspondence & don't ring/respond in anyway. Worked for me. Hope that helps.

Now get your kids back down to McDonalds.

    nope, I like it.

those going on about BK & KFC
    SFC beats KFC anyday!

Looks like you can refuse entry and there's nothing they can do. Make sure windows and doors are locked.

debtquestions.co.uk/pro…php Not all of this is relevant.

P.s I know nothing about these things other than a quick read now.
