    Help please... buying a house and hit a problem

    hello everyone, gonna have to cut a long story short so bare with me,
    basically put an offer in for a house, offer was accepted.
    we stressed to the owners before the offer was made that we would need to move in mid december, this caused a little bump but after adding another 2 grand on to the original price they agreed, (all good so far)

    we have just paid 300 quid for someone to go round and survey the house,
    money was taken last week and the survey people went round yesterday.
    The people who currently own the house point blankly refused to let them in,
    they are now unsure of selling their house as they have nowhere lined up.

    basically its cost us 300 quid for the survey which didnt take place as they wouldnt let them in.

    ive given them a deadline of 11 tomorrow morning to decide if they are selling or not, but im still 300 quid down!!

    Can anything be done in this situation?

    I have worked for both Estate Agents and Surveyors. As the survery was not carried out, I would ask if they would carry the fee over to the next property you need surveying.

    With regards with the Sellers, there isn't much you can do as until contracts are signed, nobody is under obligation.

    I would cut my losses and look for somewhere else. At least it didn't happen further down the line.

    These people are annoying and the laws in England should be changed to stop things like this happening.

    i very much doubt that the surveyors will carry over the fee, they will claim that with time + petrol + effort etc they will still have to charge.

    i know nothing was set in stone but its bang out of order, if they are having cold feet over moving surely a little notification would of been nice instead of ignoring it and waiting for the surveyors to actuall call round.
    If need be is there anyway i can pass on the costs on to the house owners?
    i dont want to bee 300 quid out of pocket over this.

    It's impossible to pass on the costs, unless the house purchase goes through, in which case you could argue it out of them- after all, you are in the right. I've found surveyors to be pretty reasonable when the circumstances are explained; after all, good service and a little understanding will build their reputation. It all depends on the firm and their ethos I guess.

    You have my sympathies, I once came back from the US to a house move that had fallen apart- and ended up living in a single room for a month. Not good!

    Sorry to hear your news rockatin, we got scr*wed over twice on our last house move - despite offering the full asking price on 2 houses: one took an offer 10k less (?!) and one ecided they didn't want to move after all. It's just not fair, is it?

    Although the surveyors could reasonably claim some money for time + petrol, they didn't really put that much effort in - eg they didn't take any measurements or write the report.

    So I think what priss says is right - it's fair to ask them to give you at least a partial refund - say 50% (but I'd start asking for a full refund - then ask them to give it as a full credit against the survey on your next house - then start negotiating over % refunds).

    If they refuse point blank to budge on price and insist on billing you the full amount, then take your business next time elsewhere.

    I'd also ask the vendors directly to pay for the bill. Worst they can say is no, and you never know, they might have a conscience and agree to pay, or go 50/50. You've got nothing to lose by asking.

    Did you arrange for the surveyor to go round without asking the people whose house it was? When we bought our house the time & date the property was surveyed was agreed between the surveyors & the sellers, we never had much to do with it...

    At least you haven't incurred hefty Solicitor's fees.

    Agreed. They cant charge you for a survey that wasnt carried out - and I would certainly tell them its their responsibility to have made the appointment with the vendor before just turning up. But when you speak - be gentle - your'll get further that way!

    £300 isn't really a lot to lose! Have friends who have lost a lot more in searches, surveys and other fee's on a number of different properties!

    It's a buyers market at the moment, so don't let these goons mess you around!

    i agree 300 quid is not alot to lose...but 300 quid is 300 quid.

    The 300 quid has already been taken from our account.
    on everyones advice i will ask the surveyors if they could refund or reduce next time etc.
    Its just a big pain in the ****, you think everything is sorted then something like this happens, why would you put your house on the market then decide last minute not to sell, makes no sense to me. so much effort and time has gone into this.

    well on a 200,000 house

    Fees would be 6800.20

    so you would be left with 193199.80
