Help Virgin Mobile renewed my contract without asking me!

Has anyone got any advice for me please? I am in shock and angry!

on the 2nd December 2009 I took out a 2 year contract with Virgin and I got a free Blackberry phone...

I have just phoned Virgin to ask them what my options are as the contarct ends soon and enquired about another phone/tariff. I thought to myself I might leave if there's nothing attractive.

The opertator said that my contract was renewed in february 2011 for another 2 years because I didnt pay my bill for 6 weeks. So when i did finally pay my bill they started the contract over again. I wasnt informed of this! and now im stuck in another 2 year contract with an old broken blackberry phone, not happy

That is the full story, like I said i'm in shock..........she told me because i took so long to pay my bill they cancelled my contract, so when I did pay them they automatically renewed the contract for another 2 years...it runs out feb 2013.
I've got phone their retentions dept tomorrow.

Read the t&c to see if it says that they can renew your contract if you don't pay your bills.

Nonsense. They don't just cancel contracts because the bill isn't paid. Youd have to pay cancellation fees and your credit record would be marked. And you're claiming that they just put you on a new contract despite defaulting in the original?
serves you right for not paying them for 6 weeks

what if you didnt get wages/dole money for 6 weeks?
I think sindy got cutoff for non payment and then she paid them but the cutoff still stood and the only way was to start a new contract.

you probably should have told them you couldn't pay for 6 weeks then this would not have happened
Dimebars..really not in the mood to justify myself...i'm stating what happened.......yes I should of paid on time but really thought other things were more important to pay at the time...i'm not bored and wanting to come here to make stuff up....just want some advice thats all...and maybe a laugh???
prob get them on "unfair contracr rules" they will give in just to keep you

I can't find anything in the t&c that says they can renew or start a new contract if you make your payments late. They didn't even inform you that they are renewing your contract.

This no sense at all.

SO you had a 24 month contract which was renewed after 14 months.
They supposedly cancelled it after 6 weeks for non payment, which makes alot of sense, if I had a business where a client didnt pay I would still want their custom?
If you hadn'y have paid your bill they would have cut the phone off especially if they had cancelled your contract, could you still make calls?

There must be more to this story, you sure you got a 24 month contract and took it out in December?

As a side issue, any chance you could quote and then reply. Apart from the fact it saves people having to read the bottom bit and then read the top bit its also bloody annoying.

Anyway back to your problem, I would not have thought that this was in anyway legal. I would have thought you would be on a rolling 1 month contract until you contacted them. I would check your t&c's. Even if it is in your terms it doesn't automatically make them fair terms and my next step would be the CAB.

Just phoned Virgin, they were very helpful and the woman I spoke to was lovely.

They apologized and said it was a mistake that they renewed my contract, when i lapsed by not paying my bill apparently they said I was diconnected but when I did pay my bill they renewed the contract by mistake.
I receive my new HTC Desire S phone tomorrow and a better deal package and theyve knocked off £5 a month due to customer loyalty and being with them for 14 years :P

Out of all the new phones they gave you a Desire S?
