Help- where do i stand?

Hey all. Im living in Uni halls. Last night someone was sick on the carpet in my levels hallway. Nobody in any of the rooms has any idea who it was. Anyway the company who owns the halls cleaned the vomit away today and have invoiced our whole floor for the cleaning. So 4 different rooms. Everyone maintains that it was none of us - and it could quite easily of been a randomer.

Where do we stand? Is it our responsibility to pick up other peoples sick from corridors and lifts?

it doesnt seem right that i have to pay for some knobhead who cant make it to their own bloody bathroom.

I need to know where i stand before i go down and have a go at them.
Cant find the bloody contract anywhere also

sounds like something that happened to me a few years ago. Some one on our floor let off the fire extinguisher. Same as you, no one would own up and they all said it could have been someone else. they wanted to charge all 12 of us 15 pound. We didnt pay, and it just went away.

But i do not know what will happen with you, as i was in official uni halls, and urs sound private.

Welcome to the real world...I own my own flat on the ground floor. I pay £100 a month factors fees for lighting the whole building, lifts etc. The majority of people in the building are students renting and I regularly have to 'top up' my monthly fee to pay for clean up of student sick, fire call outs, door smashing, dumping etc etc

okay well i found the contract.
Here are two excerts:

the tenant agrees:
to pay a fair and reasonable proportion, as determined by the landlord acting reasonably, of the costs incurred by the landlord in making good damage to the room, the flat THE BUILDING COMMON PARTS and in replacing any fixtures or fittings damaged therein which arises due to any act of the tenant or any failure by the teneant to observe and comply with the obligations . if there is no evidence to the contrary then the cost of repairing any damage shall be apportioned as if:

the tenant caused damage to the room

all the tenants of the flat caused the damage to the shared facility

all the tentants entitled to use the building common parts caused the damage to the building common parts.

to allow the landlord those authorisd by the landlord upon reasonable written notice to enter the flat to:
inspect condition

carry out necessary repairs












thats one part.

however the landlord agrees to:

Maintain repair decorate and provide adequate heating and lighting to the building common parts and the flat common parts and to CLEAN the building common parts...

How is it a joke?

It's not a normal occurence to be cleaning up vomit therefore its charged as an extra over!

It's like ordering a side of onion rings - they dont form part of the main dish so you pay for them!!

facts are youy dont know whether it was a random or not. someone could be pulling the wool to avoid paying it all themselves!

the terms and conditions are clear to all - you signed them, you live by them!

either that or you need a vigilante mob to weed out the randoms

separate issue that you have to take up with the landlord - get the locks fixed as you are paying for secure accommodation that is unsecured

im sure next time you will be more observant and keep ur eye out for people abusing someone elses property and stopm it from happening next time.........maybe buy a cheap spy cam from deal extreme on the off chance they come back

lol halls charges are water tight, you are responsible for the common areas along with the other tenants there, maybe its to instill a duty of care.....................

just yesterday some tramp came up to our room knocking on the door asking for money!!!

I suppose the lesson to be learned here is not to let anyone in the door!........or clean up the mess before a cleaning company gets to it first.

YOU MUST GET ONTO LANDLORD TO FIX DOOR LOCK.....but surely you must have known that!

Well I would not pay, or live there, untill they sort it out. The sick thing is a point to argue. Of course other, more likely to be a, student is going to wonder in if there is no secuirity. I would have a go! ;-)

as already said, seperate issue, what have you done about this, it isn the landlords reposibilty to make sure the building is secure, but not up to him to make sure you lot close the door behind you, so would you happily pay it if the door was just left open by one of your mates

i dont think u understand. the door is broken. its left open all night. we were given swipe cards. but they stopped working cos the door is broken so just left permanently open. But yeah that is a seprate point to the sick - but helps to further my point it could easily be a randomer.

it doesnt further anything, have you reported the locks to your landlord, you are responsible whoever chucked up, whether it be your mum, dad, mate, randomer, you cannot prove who it was so you have to pay for it

I'd suggest in the future you'd have zip all chance of getting it nulled because of some random but if you're doors are broken and they've been informed but aren't fixing it as a matter of urgency then you can argue that this is what they're bringing on themselves by not doing it and how there are random people loitering the halls. They'll have cameras in there so you could prove that people are able to walk straight in off the street like the tramp and they'll be a bit screwed.

Not Cardiff Uni is it? One of my mates had a very similar thing on his FB status this morning!

They are not, we got charged when i was in my first year in halls for some damages. We all petitioned due to the nature of the floors are that anyone in the building can access any floor whenever they wish, everyone on our floors who were being charged and some others signed it. We got the bill the bill removed, paid nothing, and then got the terms changed (supposedly) for future reference that common areas due to the nature of the halls we lived in and their open access.

Always worth a try...especially if you are sure it was no one on your floor.

as of yet i still havent seen a response to if this door loick hads been reported, or if the landlord is telepathic ;-)
