    Holiday leave whilst on maternity leave entitlement

    Hi was hoping someone would maybe know a bit about holiday pay entitlements whilst on maternity leave.
    Before i went onto maternity leave my holiday entitlement was 219 hours paid holiday a year i had only taken 48 hours. I was then made redundant only 7 weeks into maternity leave they have carried on paying me maternity leave weekly and now its come to the end they have only paid me £400 holiday pay but i beleive that i should have 219 hours divided by 52 weeks = 4.2 then multiplied by 39 weeks leave = 163.8 then multiplied by my hourly rate of 7.56 = £1238
    Does anyone know what my entitlement should be and if ive worked this out correctly?

    You will need to check your contract as it varies depending on company

    All it says is holidays will still be accrued whilst on maternity leave and will be paid at the end of the leave

    maybe they are paying you them weekly instead of a lump sum, im due back from maternity leave middle of april but i had 2weeks holiday left so ive just added it onto the end of my leave, i found out i was pregnant again 2days ago so im going to have my hands full by the end of the year lol

    I was only working for them for a year when i was made redundant 7 weeks into maternity leave and was told because they had started to pay me smp by law they had to carry on until the 39 weeks was over and holiday pay couldnt be paid til the 39th week

    i was paid my holiday pay while i was on mat leave, but i think all companys are different and it depends how long youve been with them, just giv them a ring and ask

    I tried to ring there head office up but they just keep transfering me to different departments it seems that im the only one still being paid from the company i was working at and they just want to get me out the way
    At one point they did say they would be paying any holidays i had left with my redundancy but then when it came to they said by law they couldnt

    my company also said they can't pay my accrued holiday until I stop receiving smp. maybe this is the law. get your company to put in writing, they will pay your holiday when smp has finish.

    It is an ambiguous situation but look here for guidance and DEFINITELY call ACAS for advice.

    The law states that holiday accrues throughout your maternity period, and the employee must take the holiday before, or immediately after the maternity leave. Given this, they should have paid you your full entitlement to the end of your employement.

    thank you all for your help, i have phoned them to speak to pay role they say they will look into it for me, think i might be best asking acas if its posible for advice in writing so that i can give it to them so they see they do have to pay it, i will leave rep for all that have helped

    It's a very risky thing to make someone redundant while on maternity as you should be the last to go.

    I would talk to ACAS about this as well

    The full factory closed down, we was all offered to work over in hull but didnt fancy the 45 min drive each way to work. I probably wouldnt have gone back to work for them anyway doing 12 hour days and leaving my son so in a way they did me a favour
