    is anyone clued up on maternity rights/leave?

    my mat leave started sept 2nd 07
    im due back 31st august if i have 12 months
    but back begining of june if i return after 9 months of paid smp(smp ends 31st may)
    i cant seem to find out if i decide to let them know now that i will not be returning to work will they still pay my smp up until 31st may or will they just stop paying me from when i tell them i wont be coming back?
    also if i tell them i wont be returning am i free to get another job straight away?
    been looking on net but cant seem to get an answer for this,and dont want to ring work incase they start questioning my whether im returning or not

    you don't have to tell them whether you are returning or not, my missus fully intended to return then changed her mind....if they are paying you maternity leave I don't think you can then go and get another job, probably break terms of your contract anyway.

    what i was thinking of doing was giving them a months notice that i wont be returning
    so i would tell them 1st may that i wont be returning when my smp runs out on the 31st may
    but i dont want to do that if it means i lose my last months smp
    and then look for another job,as long as its ok to do so

    Don't forget you'll have accrued holiday entitlement during your maternity leave. ;-)

    dont think i will have any A/l as i took it before i had my maternity leave in sept so ii think i will only have hols from april 08
    maybe i will be best waiting then until i find another job before informing them i wont be returning,i wont be losing any money that way
    i feel a bit bad for stringing them along but then i remember how [email protected]@p they were when i had my son stillborn apparantly my boss knew exactly how i felt as she had had a hysterectamy

    have you had full entitlement, when i went onto maternity leave there was an amount you could have paid as a lump sum when you returned to work, or have it topped up on your smp, if you didnt return to work for 3 months this money had to be paid back, dont know if things have changed

    you get so much at full pay, then so much at lower pay that is topped up by smp, its the lower pay you hve to pay back if you dont return to work, i think

    oh dear im worried now
    i got 80% of my wage for 6 weeks i think

    then £117 or arond that a week smp :?

    My wife has just finished her 9 months maternity leave, she asked to go back part time 2 months ago but the company wouldn't allow it, She then put her notice in at that point saying she would be leaving at the end of her maternity leave (she only had to give one months notice) company said no problem she would be paid her SMP up until she left also the holiday she had accrued.

    Its meant to be 90% for the first 6 weeks then £117 a week SMP

    The way I understand it is companys have to pay 80/90% of the first 6 weeks anyway.

    your best bet would be to drop into your local citizens advice bureau, their advice is free and strictly confidential - they will be able to answer your questions regarding smp.

    what if i start work in a new job for another employer?

    If you start work for a new employer before your baby is born, your SMP is not affected.
    After the baby is born, if you work for an employer who did not employ you in the 15th week before your baby was due, your SMP must stop. You must tell the employer paying you.
