    Item delivered to wrong address, where do I stand.

    I ordered an item but apparently it has been delivered and signed. Not by me and not to my address either. Where do I stand with this. How do I prove that the item has not been delivered to my address. Really concerned as this was an expensive present.

    Where's it from and how did you pay.

    Did you give the seller the correct address.

    It is down to the delivery company to deliver to the correct address - so if you can prove it was delivered to the wrong address then whoever you ordered from should reimburse you and seek redress from the delivery company. Did you pay by credit card?

    its not up to you to prove it WASNT delivered-its up to them to prove it WAS! tell them to fax you a copy of the signature if they claim its been signed for. A contract is only complete when they deliver to the CORRECT address.

    They have now said the item was delivered to another address, but is the delivery driver likely to remember where to as at this time of year they are so busy. How else will they know where it has gone too.

    If they didnt send it recorded delivery, and there's no way to confirm if/where the item was delivered then the sender has to refund/resend again.

    inb4 a 'I've had an expensive item delivered by mistake, can I keep it' post.

    Agree with cdm22 if they are admitting they have sent it to the wrong address (how they'd know is beyond me) then there is little to worry about apart from the timing of the refund.

    Paid by credit card so covered there, next day delivery by a large grocery firm.
    Sorry too engrossed in the ironing!.

    Hopefully the person who has signed for it will do something. I don't hold my breath though, lovely christmas present.

    hope its not too valuable because if you customer complain with royal mail and win,you only get max.of £39 (if recorded item).my missus sold and sent something she sold on flea bay (about 18 months ago) for £125.the postie signed for it and left it outside the address and it got nicked! (all verified by RM and all she got back was £39.she also had to reimburse the buyer too !) good luck

    As an aside to that, the recipent can keep it as an unsolicited gift but only if the adress on the shiping documents and delivery address are the same.

    128. Subsection (3) makes it an offence for a person, intending to act to a person's detriment and without reasonable excuse, to open a postal packet which he knows or suspects has been incorrectly delivered to him.

    Now that's the rub isn't it because is a courier covered by that act as most Parcels are delivered by Private Couriers who are not contracted to the postal commission which the previous act was set up to regulate.

    I did mention that the delivery adress should be the same as that on the shipping documents.

    Also the part of the Act you refer to is actually Part V Provision 84 subsection (3)

As i would of thought if it was my first point you would of got a card posted stating it has been left with suchabody at suchaddress, and im not being funny but if i was the other person who recieved the parcel, and the address on it was not mine, i would gladly take it where it belonged, as if they signed for it, and you do take it further they will get there hands smacked! Have you rung and asked where it was delivered and for the signature, as you could then go on the electroroll (sorry cant spell it), thats if you can read the signature, and see if its anyone within your street :o)

    The courier says it was definitely on his van and must have been delivered to wrong address. But with them being busy at this time of year will the courier even remember where he delivered it. No a card was put through the door and I have been in all day waiting for it to arrive.

    No card was not put through my door. sorry just read back not very clear was it!

    We thought a parcel had been stolen once before - got a card saying it was left around the back of the house (even though we have never made any note to anyone to leave it near the house or with a neighbour but they still do), we looked for hours!

    Turns out he left it in the bloody barbecue!
