    Just bought a cat D

    Hiya. I just bought a car from a dealer only to find out when I got home that it has previously been a cat D write off. It wasn't advertised as a cat D so might try to return it to the dealer as I was missold? Any advice on what to do would be appreciated.

    Main dealer, back street, online dealer?

    I would think it would depend on how it was advertised ? - or what it was "portrayed " as .

    It wasn't a main dealer, however it is a proper company with its own premises etc.Not just a private seller with a few cars

    The advert never states anything about it being previously written off.

    Approach the dealer and find out what they are prepared to do about, before doing anything else.

    You should always ask for a print out of a HPI Check before buying a used car.

    Do they advertise their cars as being hpi checked if so then they should of known and informed you

    and yeah I made a mistake not doing that! normally do check all of those things but just forgot today guess it's because I'm ill!

    If they claim to be hpi clear and haven't informed you then do as inactive says " pop in to see them and ask them what they are prepared to do " if they are net being helpful you may need to talk to your local trading standards

    screenshot the website that says 100% HPI checked, try get it in other saved formats too. I've seen companies changing their terms and conditions of sales 5 mins after ending a phone call - cougar manufacturing done that after they tried to claim they don't offer returns on spare parts after I was miss sold a product and they said this was stated in their terms and conditions, it wasn't even written there, I told them I couldn't see it and 5 minutes later it was changed, sleazy lying ****...

    advertising laws apply to all types of merchant. if they failed to tell you it was a cat d or did not advertise the vehicle as such, they have failed to meet their obligations

    How about just going to see them and asking for your money back?

    You may find they are happy to refund, why look for a problem that's not there yet?

    Return the car and print out the original ad. keep a copy of the ad for yourself and approach the dealer with the original ad to. If the dealer doesn't return the money or exchange the car i would the contact the small claims court and trading standards.
    But i cant see why the dealer wont just refund or exchange the car as its a clear mistake on there part. i would guess they must have forgot to mention the car was a cat d or overlooked it as they would normally check all cars for hpi.

    Also record as much as possible on your camera phone when you go back as it will all add as evidence if things go wrong.

    We agreed to purchase a car last year and paid a substantial deposit. Told it was HPI clear, I did an independent RAC check which showed finance outstanding. The dealer was initially reluctant to refund us, so I contacted Trading Standards and told the dealer I had done so. Money was refunded plus £50 compensation next day. Turned out well, as if we had bought the car it had a 8k loan attached to it.
    Always get your own HPI check.

    Approach dealer and state your case. If you want your money back state you are rejecting the car.

    If dealer give satisfactory solution, job done.

    same thing happened to me a few years back. went straight back to the garage and they offered me either a full refund or pick any other car and they will refund the difference ... no problem, and this was just a small 2nd hand dealer that has around 20ish cars. it was a simple error on their behalf, but they have profited from me by me buying more cars off them over the last few years.
