    Just checking rights for a friends faulty laptop

    Ok my flatmate has a 5 month old laptop which stopped working, Vista seems to have vanished and wont boot.

    She took it to uni who messed around with it so she cant get into recovery parition.

    She got it from Currys who refuse to help saying Acer have to deal with it, but when she phoned Acer they just say she has to spend £50 buying a new recovery disc which takes about a month to arrive because they need to send her a form where she has to put in her serial numbers etc.

    Or pay £70 for them to collect and "fix" it.

    Useless basically but is there anything she can do since its still under warranty?

    Download a copy of the recovery disc, it's probably floating around somewhere.

    if she denies all knowlege of someone messing with it, then currys are liable for 12month to offer repair replace or refund as they are the retailer you bought it off not acer, currys merely bought it from acer. they use scare tactics at currys, dont let em get to you. they tried it with my g/f so being a manager of a retail unit i went in and laid down the law and hey presto they got it sorted. they play on you so they keep their costs down, the worst customer service i have ever known. not bought (or intending to) buy anything again from dixons group.

    The problem here is the unit may not be faulty, pretty sure as far as software is concerned it's down to the user as windows can simply be re-installed.
    The SOGA does not cover the user not knowing how to deal with software issues.

    This is one of those areas, like others have pointed out, where there are two answers.
    Currys were wrong to say that Acer have to deal with the problem. The contract is with them but sometimes it can work out quicker to deal direct!
    As long as you have the receipt, then the onus is on Currys to prove the laptop has a fault within the first 6 months. If it is over 6 months, then the onus is on you. Where there are two answers are 1) if this is simply a software fault and Windows needs to re-installed then a charge will be made. If this is the case then find someone/look on the web who has a recovery disc or even a upgrade disc.
    2) If it is a hardware issue eg Harddrive failure then it should be repaired FOC within a reasonable time period.
