    Legal Rights When Being Laid-off Without Pay?

    I've been laid off with no pay and don't know when I will be back at work. I've worked full time for over 20 years with my employer and theirs nothing in my contract about being laid off without pay. Any advice what to do? Can I claim anything?

    Contact trade union or ACAS, your employer cannot just lay you off.

    Agree totally. Some people who gloat at others misfortune are reprehensible.

    Laughing and making jokes when someone has lost there income is not funny....cant stoop much lower,that particular poster showing his true colours,good to see the mods on the case.

    If there's nothing in the contract regarding lay off pay, I would suggest they have to pay you... without reading your contract and knowing a little about the company, I can't be certain. I would second suggestions to call ACAS or go to the CAB - they are both very good places to seek such advice. Do you have a shop floor rep or union rep you can speak to? Are you the only one or is the whole place on short time? There are rules regarding claiming guarantee payments so read thoroughly the top two links given in this thread (and anything relevant that THEY link to as well), and make sure you keep copies of everything you need to file incase of everything going pear shaped with the company as a whole. Hopefully it's just a temporary thing, it could be a lot worse. Fingers crossed it all works out for you though.:(

Y ou would have to wait for the Administrators to go through company finances and employess are usually the last to be paid.When it happened to me I had to wait 6 months before I got my pay that was due to me. I hope it works out for you I've been made redundant 3 times, so know it's not nice especially this time of year

    If they HAVE gone into administration I really feel for you as it screws up all sorts of things like future references etc. Keep strong OP.

    You have employment rights if you worked there for that long.
    You need to contact your local law centre which should be free or your Citizens Advice Bureau if you havn't got one nearby.

    Statutory redundancy pay. Employers cannot exempt themselves as it's statutory

    It happened to me this time last year,couldnt give me an answer when i would be back spoke to a few advisors and my union and I was basically told that if they dont pay you after the 5th week you can ask to be made redundant and they can either accept to pay your redundancy or take you you back,but if your not earning you can always claim dole its not nice but its something no shame claiming if you've worked for 20yrs you deserve some support!!!! the 5 week thing I dont think is cast in stone but its usually acceptable.
    Just make sure you've got your contract,record of your holidays and if you can try and get a reference off someone there now even,everything helps
